PC R 94-1457RrSOLUTION NO. 94-1457 A R�SOLUTION OF THC PLANNING COMMISSION OF TIIE CITY OF ARROY� GRANDI: APPROVING PLANN�D SIGK PROGRAM CASE NO. 93 FOR E. C. LOOMIS & SON AT 405 EAST I3RANCH STRL+'E'I' WII�REAS, the Planning Commission of the City of Arroyo Grande has considered an application by E. C. Loomis & Son for a Planned Sign Program at 405 East Branch Street, in the Village General Commercial District; and " WIIER�AS, the Planning Commission has found that this planned sign program is consistent with the General Plan; and WIIER�AS, the Planning Commission has reviewed this project in con�pliance with the California Environmental Quality Act (CEQA) and has detennined that the project is categorically exempt per CEQA Guidelines Section 15311; and WIi�RCAS, the Planning Conunission f111CIS� after due study, deliberation ancl public hearing, the following circumstances exist: 1. The proposed signs are consistent with the goals, objectives, policies and programs of the Arroyo Grande General Plan. The proposed signs balance the need for identification of businesses with the rural small town cl�aracter of the communily. 2. Tl�e proposed signs conform to applicable development standarcls and provisions of tlie Development Code and will not be detrimentai to the public health, safely or welfare. 3. The physical location or placement of the signs are compatible with the surrounding neigliborl�ood and do not pose a safety risk. NOW, TIIGR�rORE, B� I'I' RESOLV�ll lhat the Planning Commission of the City of Arroyo Grande hereby approves said Planned Sign Program, subject to the following conditions of approval: General Conditions 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to tl�is project. 2. This application shall aulomatically expire on February 1 1996 unless a building permit is issued and substantial construction is commenced and diligently pursued toward complelion, or a final inspection is conducted. Thirty (30) days prior to tlie expiratioil of the approval, the applicant may apply to the Planning Commission for an extension of one (1) year from tt�e original date of expiralion. 3. Development shall occur in substantial conformance with the plans presented to lhe Planning Commission at the meeting of I=ebruary 1, 1994 and marked "Exllibit A". The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance oE said approval, or in the alternative, to relinquish such approvaL The applicant shall reirnburse the City, its agents, officers, or employers, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court tv pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Architectural Advisory Commit.tee Conditions 5. Prior to construction of the sign, an older style of font shall be proposed and after approval by the Planning Director shall be used for the tenant panels. 6. 7. Each tenant shall only be allowed one sign panel. The large tenant sign shall be constructed similarly to the header sign.
