PC R 93-1429RESOLUTION NO. 93-1429 A RFSOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A WATER TREATMENT AND DISTRIBUTION CENTER IS NOT A PERMITTED USE IN THE HIGHWAY COMMERCIAL ZONE WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title; and WHEREAS, Development Code Table 9-07.030-A lists uses permitted in the Highway Commercial zone; and WHEREAS, Table 9-07.030-A does not clearly indicate whether a water treatment and distributing center is a conditionally permitted use in the zone; and WHEREAS, Table 9-07.030-A allows the Planning Commission to determine that a proposed use is similar to, and no more objectionable than the uses identified in the table; and WHEREAS, The Planning Commission has received a request for interpretation of whether water treatment and distribution center can operate their business in the Highway Commercial zone; and � WHEREAS, the Planning Commission, after due research and deliberation finds that: � '� I �� 1. The proposed use, water treatment and distribution center, is NOT similar to uses permifted in the Highway Commercial zone. Permitted uses auto related uses and uses that serve visitors to the city. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Anoyo Grande hereby makes the interpretation that water treatment and distribution center is NOT a permitted use in the Highway Commercial zoning designation. On motion of Commissioner Soto, seconded by Commissioner Reilly, and on the following roll call vote, to wit: AYFS: Commissioners Tappan, Soto, Reilly and Chairman Carr NOES: Commissioner Deviny ABSENT: Commissioners Hatchett and Keen the foregoing Resolution was passed and adopted this 17th day of August, 1993.
