RESOLUTION NO. 93-1417
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE RECOMI�ZENDING
THAT THE CITY COUNCIL ADOPT THE NOISE
ELEMENT OF THE GENERAL PLAN, ADOPT THE
NEGATIVE DECLARATION AND INSTRUCT THE CITY
CLERK TO FILE A NOTICE OF DETERMINATION
WHEREAS, Section 65302 of the California Government Code directs all cities and
counties to prepare General Plan Noise Elements; and
WHEREAS, said Government Code Section also requires the Noise Element to recognize
the guidelines established by the Office of Noise Control in the State Department of Health
Services; and
WHEREAS, the City of Arroyo Grande has determined that it is appropriate and
necessary to update and revise the previous Noise Element adopted by the City; and
WHEREAS, duly noticed public hearings were held by the Planning Commission of the
City of Arroyo Grande on April 6, 1993, and May 18, 1993 at which all interested persons were
given the opportunity to be heard; and
WHEREAS, the Planning Commission reviewed the potential environmental impacts of
the proposed Noise Element in compliance with California Environmental Quality Act (CEQA),
the State CEQA Guidelines, and the City's Rules and Procedures; and
WHEREAS, the Planning Commission has reviewed and considered the information and
public testimony presented at the public hearings and in the proposed documents and staff
reports.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Arroyo Grande, California to recommend to the City Council adoption of a Negative
Declaration and adoption of the updated Noise Element based on the following findings:
General Plan Update
1. The proposed update of the noise element is consistent with the goals, objectives,
policies, and programs of the General Plan and will not result in any internal
inconsistencies within the plan.
2. The proposed update of the noise element will not adversely affect the public health,
safety, and welfare because the update will promote the public health and welfare by
reducing the harmful and annoying effects of excessive noise exposure, such as hearing
loss, high blood pressure, stress related disorders, interference will conversation and
sleep, lost productivity in the work place, and lower property values.
3. Based on the Initial Study and all the comments received, the potential environmental
impacts of the proposed update of the noise element are insignificant.
Noise Element Findings
l. The proposed update will provide for compatible development in terms of noise exposure
by minimizing noise conflicts resulting from new and existing development. In addition,
the information in the noise element will enable establishment of land use patterns that
will minimize noise conflicts.
2. The proposed noise element is appropriate because it was prepared in accordance with
the requirements of Section 65302(fl of the California Government Code and with the
Guidelines for the Preparation and Content of the Noise Element of the General Plan
prepared by the California Department of Health Services. In addition, the proposed
noise standards are justified based on existing noise levels identified in a community
noise survey.

Department of Fish and Game Required Findings of Exemption
1. The City of Arroyo Grande has prepared an initial study pursuant to Section 15063 of
the Guidelines of the California Environmental Quality Act (CEQA), for the draft noise
element.
2. Based on the initial study, a negative declaration drafted for review by the public and
review and approval by the Planning Commission.
3. After holding a public hearing pursuant to State and City Codes, and considering the
record as a whole the Planning Commission adopted the negative declaration and found
that there is no substantial evidence of any significant adverse effect, either individually
or cumulatively on wildlife resources as defined by Section 711.2 of the Fish and Game
Code or on the habitat upon which the wildlife depends as a result of development of this
project.
On motion by Commissioner Tappan, seconded by Commissioner Deviny, and on the following
roll call vote, to wit:
AYES: Commissioners Tappan, Reilly, Deviny, Hatchett, and Chairman Soto
NOES: None
ABSENT: Commissioner Carr
the foregoing Resolution was passed and adopted this 18th day of May, 1993.
