PC R 93-14082 9�6 RESOLUTION NO. 93-1408 A RFSOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A KEY MARKETING IS A PERMITTED USE, SUBJECT TO ISSUANCE OF A CONDITIONAL USE PERNIIT, AT 201 BRISCO ROAD, IN THE INDUSTRIAL ZONE. WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title; and WHEREAS, Development Code Table 9-04.030-A lists uses permitted in the Industrial zone; and WHEREAS, Table 9-04.030-A does not clearly indicate whether the business described as Key Marketing is a conditionally permitted use in the zone; and WHEREAS, Table 9-04.030-A allows the Planning Commission to determine that a proposed use is similar to, and no more objectionable than the uses identified in the table; and WHEREAS, The Planning Commission has received a request for interpretation of whether Key Marketing can operate their business in the Industrial zone; and WHEREAS, the Planning Commission, after due research and deliberation finds that: 1. 2. The proposed use, Key Marketing, is similar to uses permitted in the Industrial zone; and The proposed use, Key Marketing is no more objectionable than the uses identified in Table 9-04.030-A. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby makes the interpretation that Key Marketing is a permitted use in the Industrial zone subject to issuance of a Conditional Use Permit. On motion of Commissioner Reilly, seconded by Commissioner Tappan, and on the following roll call vote, to wit: AYFS: Commissioners Moore, Hatchett, Deviny, Tappan, Reilly and Chairman Soto � NOES: Commissioner Carr ABSENT: None the foregoing Resolution was passed and adopted this 16th day of February, 1993.
