RFSOLUTION NO. 92-1394
A RESOLUTION OF THE PLANNING CONIlVIISSION OF THE CITY OF
ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE
DEVELOPMENT CODE REGARDING KIOSKS
WHEREAS, the Development Code was adopted by the City Council on May 14, 1991,
and became effective on June 13, 1991; and
WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning
Commission with the authority to clarify ambiguities in the Title; and
WgIEREAS, Kiosks are permitted in certain commercial zones in the City, subject to
obtaining a Conditional Use Permit; and
WHEREAS, The Planning Commission has received a request for interpretation of
whether kiosks constitute a use regardless of the business within them or whether a lciosk is a
structure; and
W�IEREAS, the Planning Commission, after due research and deliberation finds that:
1. Table 9-07.030-A of the Development Code regulates kiosks as a use.
2. Due to the inherently small size of kiosks, changes of business within kiosks are
not likely to significantly effect the environment.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Anoyo Grande hereby makes the interpretation that kiosks are a use under the provisions of
the Development Code and a change in Business within the kiosk does not change the usea
On motion by Commissioner Carr, seconded by Commissioner Soto, and by the
following roll call vote, to wit:
AYES: Commissioners Carr, Soto, Moore, Souza, Tappan, and Chairman Brandy

ABSENT: None
