RESOLUTION NO. 1095
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE, STATE OF CALIFORNIA, DIRECTING THE FILING OF
CONDEMNATION ACTION FOR STREET PURPOSES.
WHEREAS, the City Council of the City of Arroyo Grande, State of
California, considers that it would be advantageous to use certain property for
street purposes and it is the intention of the Arroyo Grande City Council to
construct and maintain a city street on the land more particularly described in
Exhibit "A", attached hereto and by this reference made a part hereof.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
1. The City Council of the City of Arroyo Grande has found and
determined that the public interest and necessity require the acquisition,
construction, or completion by said City of a roadway over, above and across
the property described in Exhibit "A".
20 The City Council of the City of Arroyo Grande has found and determined
that a fee interest in the property described in Exhibit "A" is necessary.
3. That the law firm of SHIPSEY & SEITZ, INC., who are attorneys for the
said City, be and they are hereby directed to institute and conduct to conclusion
an action in eminent domain for the acquisition of the estates and interests
aforesaid and to take such action as is necessary therein and said law firm of
SHIPSEY & SEITZ, INC, shall be paid a reasonable fee therefore.
4. That said property is located in the City of Arroyo Grande, County
of San Luis Obispo, State of California, and is described in Exhibit "A" which
is attached hereto and by this reference made a part hereof.
On motion of Councilman de Leon, seconded by Councilman Spierling and on
the following roll call vote, to wit:
AYES: Councilmen Spierling, de Leon, Schlegel and Mayor Pro Tem Millis
NOES: None
ABSENT: Mayor Talley
the foregoing resolution was passed and adopted this 14th day of May, 1974.

of the County of San Luis Obispo, State of California, lying southerly
of the northerly Plan Line as shown on a map entitled "Amended plan
Line of Cherry Avenue" between Traffic Way and Railroad Avenue filed
in Book 1, Page 22 of Plan Line Maps filed in the Office of the County
Recorder of said County and included within. the lines of the land
described in deed to A. Wayne Luke, et ux by joint tenancy deed dated
August 9, 1948 and recorded August 14, 1948 in Book 484, Page 379 of
Official Records of said County.

Recorder of the County of San Luis Obispo, State of California, lying

plan Line of Cherry Avenue" between Traffic Way and Railroad Avenue filed
in Book 1, Page 22 of Plan Line Maps filed in the Office of the County
Recorder of said County and included within the lines of the land
described in deed to Kathy Wilson, a widow, as her sole and separate
property by Grant Deed dated August 18, 1971, and recorded September 2,
