PC R 92-13631 5� 8 RESOLUTION NO. 92-1363 A RFSOLUTION OF THE PLANNING CONIlVIISSION OF THE CITY OF ARROYO GRANDE APPROVING SIGN PERMIT CASE NO. 91-103, A PLANNED SIGN PROGRAM FOR A PROFESSIONAL OFFICE BUII,DING, APPLIED FOR BY THE RICHARD RAr�IIREZ AT 124 SOUTH HALCYON ROAD. WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application by Richard Ramirez for a Sign Permit at 124 S. Halcyon Road in the General Commercial District; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that a Negative Declaration can be adopted, and instructs the Secretary to file a Notice of Determination; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed signs are consistent with the goals, objectives, policies and programs of the Anoyo Grande General Plan. 2. The proposed signs conform to all applicable development standards and the provisions of the Development Code and will not be detrimental to the public health, safety or welfare. 3. The physical location or placement of the signs is compatible with the surrounding neighborhood and does not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approved said Sign Permit, subject to the following conditions of approval: General Conditions 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meedng of January 21, 1992 and marked "Exhibit A" . 3. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 4. This application shall automatically expire on January 21, 1994 unless a building permit is issued and substantial construction is commenced and diligently pursued toward completion. Thirty (30) days prior to the expiration of the approval, the applicant must apply to the Planning Commission for an extension of one (1) year from the original date of expiration or extension of time is desired. Planning Department Conditions 5. Development shall conform with the GC zoning requirements unless otherwise approved. The base of the monument sign shall be six inches (6") higher to prevent the sign from being blocked by landscaping. 7. The tenant sign above the door shall be shaped to match the architecture of the building. 8. The tenant signs shall mimic the monument sign in the design and location of the posts. �re Department Conditions 9. No signage may obstruct or be within three (3) feet of any Fire Department water connection.
