PC R 91-1359/s/ RESOLUTION NO. 1359 A RESOLUTION OF THE PLANNING CONIlVIISSION OF THE CITY OF ARROYO GRANDE INTERPRETING THAT NEON SIGNS ARE PERMITTED CITYWIDE UNDER CERTAIN CIRCUMSTANCES AND CLARIFYING THE DESIGN AND CONSTRUCTION STANDARDS FOR NEON SIGNS WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effecdve on 7une 3, 1991; and WHEREAS, Section 9-01.110 (G) (3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title; and WHEREAS, the sign ordinance was not changed by adoption of the Development Code; and WHEREAS, Section 9-13.060 (n of the Development Code prohibits the use of exposed neon or gaseous light tubing; and W�IEREAS, Section 9-13.050 of the Development Code, "Sign Prohibited" does not include a prohibition against the use of neon signs; and WHEREAS, there has been confusion about the use of neon signs in the City of Anoyo Grande; and VV�IEREAS, the Planning Commission after due research and deliberation finds that: 1. Neon signs are not prohibited by the Development Code. 2. Section 9-13.060 of the Development Code prohibits the use of exposed neon or gaseous light tubing, but does not prohibit neon or gaseous light tubing that is properly shielded. 3. The design and construction of neon signs are regulated by Section 9-13.060 of the Development Code and as clarified herein below. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Anoyo Grande hereby makes the interpretation that neon signs are permitted citywide under certain circumstances, and herein clarifies the design and construction standards for said neon signs as follows: 1. All neon tubing shall be covered with transparent or translucent material to prevent rupture; and 2. The Architectural Advisory Committee shall review and approve, or when required by the Development Code, the Planning Commission shall review and approve said signs, and that the following conditions must be met before said neon signs can be approved. a. The proposed general design, arrangement, texture, colors and lighting placement are consistent with the purposes and regulations of the sign ordinance and any design guidelines; and b. The appropriateness of the proposed neon sign is compatible to other signs and other structures on the premises and contiguous area. On motion of Commissioner Souza, seconded by Commissioner Moore, and on the following roll call vote, to wit: AYES: Commissioners Souza, Moore, Groves and Chairman Brandy NOFS: None ABSENT: Commissioners Soto, Carr and Boggess the foregoing Resolution was passed and adopted this 17th day of December, 1991.
