PC R 91-1345RrSOLUTION NO. 13 4 5 A RESOLUTION OF T�IE PLANNING COMMiSSION OF THE CITY OF ARROYO GRANDE APPROVING PARCEL MAP CASE NO. 90-490 LOCATED AT 1524 GRAND � AVENLTE .APPLIF.D FOR BY MERILEE PECK NEWDOLL WHEREAS, the Planning Commission of the City of Arroyo Grande has held public hearings on Parcel Map Case No. 90-490 in accordance with Sections 9-02.160 and 9-04.070 . ,of the Development Code of the City of Arroyo Grande; and ., . WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, this Tenative Parcel Map is part of the Central Coast Bowl Project; and WHEREAS, an Environmental Impact Report (EIR) has been prepared for the Central Coast Bowl Project; and WHEREAS, the Planning Commission has reviewed the project and the EIR in compliance with the California Environmental Quality Act and has certiCed the EIR as being prepared in compliance �with the pi•ovisions of the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City Rules and Procedures for the implementation of CEQA; ancl WHEREAS, said Parcel Map was referred to the Planning Commission, by various City Departments and the Staff Advisory Conunittee; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed Tentative Parcel Map, design and improvements of this subdivision are consistent with the goals, objectives, policies, plans, programs, intent, and requirements of the General Plan map and text and the requirements of the Development Code because the General Plan designation is General Commercial and the proposed lot sizes and configurations are adequate to allow commercial develop- ment to occur in conformance with the provisions of the General Plan for commercial areas as otitlined in Policy 3.1a of the Land Use Element. 2. This site �s shown on the revised site plan, is physically suitable for the proposed type and density of development because all necessary easements, parking, drainage facilities, and landscaping can be provided. 3. The design of the Tentative Parcel Map or the proposed improvements are not likely to cause substantial and considerable damage to the natural environment, including fish, wildlife or their habitat because an Environmental Impact Report has been prepared on the pi•oject and all significant adverse impacts identified in the report have been mitigated to a level of insignificance. 4. The proposed design of the subdivision or proposed improvements are not likely to cause public health problems because mitigation measui•es identified in the FEIR for the protection of public health have been included as conditions of approval of the project. 5. The design of the Tentative Pai•cel 1VIap or the type of improvements will not conflict with easements acquired by the public at large for access through, or use of, property within the proposed Tentat.ive Parcel Map or that alternate easements for access or for use will be provided, and that these alternative easements will be substantially equivalent to ones previously acquired by the public. Additional easements are being required as conditions of approval. RESOLUTION NUMBER 91- MERII,EE PECK NEWDOLL AUGUST 20, 1991 PAGE TWO 6. The discharge of waste from the proposed subdivision into an existing community sewer system will not result in violation of existing requirements a prescribed in Division 7(commencing with Section 13000) of the California Water Code. 7. Adequate public services and facilities exist or will be provided as the result of the proposed Tentative Parcel map. Additional water facilities will be constructed as a condition of approval of this project. NOW, THEREFORE, BE IT RFSOLVED that the Planning Commission of the City of Arroyo Grande hereby approves said Pai•cel Map Case No. 90-490 subject to the mitigation measures attached hereto as Attachment "B" and incorporated herein by reference, and subject to the conditions of approval, attached hereto as Attachment "C" and incorporated herein by reference. On motion by Commissioner carr, seconded by Chairman Gallagher, and by the following roll call vote, to wit: AYES: Commissioners Moore, Boggess, Cai•r and Chairman Gallagher NOES: None ABSENT: Commissioners Souza, Soto and Brandy the foregoing Resolution was adopted this 20th day of August, 1991.
