A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
� � ARROYO GRANDE APPROVING SIGN PERMIT CASE NO. 90-101
APPLIED FOR BY SCOLARI'S OF CALIFORI�TIA, INC.
(DBA J.J.'S FOOD COMPAN� AT 303 E. BRANCH STREET
FOR A PLANNED SIGN PROGRAM.
VVIIEREAS, the Planning Commission of the City of Arroyo Grande has considered an
application for a Planned Sign Program for signs having a total aggregate area in excess of 150
square feet at 303 E. Branch Street in the CBD Central Business District; and
WHEREAS, the Planning Commission has found that this project is consistent with the
General Plan and the Environmental Documents associated therewith; and
WHEREAS, the Planning Commission has reviewed this project in compliance with the
California Environmental Quality Act (CEQA) and has determined that this project is exempt
per Section 15311 of the CEQA Guidelines; and
WIiEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances exist:
1. The proposed signs are consistent with the intent and purpose of Section 9-4.2407
of the Zoning Ordinance as it relates to Planned Sign Programs. Variance Case
No. 90-155 was approved for mounting the signs on .the roof.
2. The proposed roof signs are visually compatible with the buildings they idendfy
by utilizing materials, colors or design motif included in the building.
3. Proposed advertising signs complement other exisdng or proposed signs on
the site by using common design elements, such as materials, letter style colors,
sign type and shape. �
4. Proposed signs are compatible with sunounding land uses and do not obscure
adjacent conforming signs.
WHEREAS, this project was reviewed by the Planning Commission and various City
departments and found to be acceptable and in conformance with the applicable codes and
ordinances.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Anoyo Grande does hereby approve said Sign Permit Case No. 90-101, subject to the
following condidons:
General Conditions
1. The applicant shall ascertain and comply with all State, County and City
requirements as are applicable to this project.
2. Development shall occur in substantial conformance with the plans presented to
the Planning Commission at the meeting of May 21, 1991 and marked "Exhibit

3. The applicant shall agree to defend at his/her sole expense any action brought
against the City, its agents, officers, or employees because of the issuance of said
approval, or in the alternative, to relinquish such approval. The applicant sha1T
reimburse the City, its agents, officers, or employers, for any court costs and
attorney's fees which the City, its agents, officers or employees may be required
by a court to pay as a result of such action. The City may, at its sole discretion,
participate at its own expense in the defense of any such action but such
participation shall not relieve applicant of his/her obligations under this condition.
Planning Department Conditions
4. Development shall conform with the CBD zoning requirements, unless otherwise
approved.

5. The signs are to be maintained in a neat and orderly. fashion.
6. Within 90 days of adoption of this resolution, the applicant shall install a frame
around, and plexiglass over the signs on the redwood portion of the building
above the shopping carts.
On motion by Commissioner Soto, seconded by Commissioner Moore, and by the
following roll call vote, to wit:
AYES: Commissioners Moore, Brandy, Souza, Boggess, Soto and Chairman Carr
NOES: None
ABSENT: Commissioner Gallagher
