W�S, the Planning Coa�mission of the City of Arroyo Grande has
considered an application by Burnet M. Poole for a 640 square foot second
residential unit at 227 Le Point Street in the R-1 zone; and
Wf�tF1�S, the Planning Co�tmission has found that this project is
consistent with the General Plan and environmental doc�.unents associated
therewith: and
WF�.S, the Planning Co�miission has reviewed the project in ca[tpliance
with the California Environmental Quality Act and has determined that a negative
declaration can be adopted and instructs the secretary to file a Notice of
Determination; and
Wf�iS, the Planning Cmmussion finds, after due study, deliberation and
public hearing, the following circw�nstances exist:

The proposed use is consistent with the General Plan's statesnents and
intent as outlined in the RR designation.
The site is adequate in shape or size for the proposed use, as it can
meet all the setback and parking requir�nents.
The site does have adequate access.
4. The proposed use will not have an adverse effect on the use of
surroi.mding properties because sufficient separation has been provided
between uses, and adequate services are available.
5. The design and layout of the proposed use is suitable because the
required setbacks, lot coverage, and other requirements of the R-1 Zone
and of Article 40 of the zoning ordinance have been r�et.
NC�I, Tf�F��ORE, BE IT RESOLVID that the Planning Coamussion of the City of Arroyo
Grande hereby approves said Conditional Use Permit, subject to appropriate
standard conditions of the City of Arroyo Grande, and the following special
conditions:

The applicant shall ascertain and carnply with all State, County and City
require�nents as are applicable to this project.
Developmnent shall occur in substantial conforn�azzce with the plans
presented to the Planning CoQmussion at the meeting of Septegnber 18,
1990, and marked "Exhibit A".
Plaiuzing Departi[�nt Conditiaris
3. Development shall confonn with the R-1 zoning requir�nts, unless
otherwise approved.
4. The applicant shall record a deed restriction and an Agree�nt Affecting
Real Property regarding the second dwelling unit in accordance with the
provisions of Article 40 of the zoning ordinance and to the satisfaction
of the City Attorney and the Planning Director, within six (6) months of
Planning Co�mission approval or close of escrow whichever is more
restrictive.
Fire Departt�re�t Couiditio�s
5. While not a condition, the Fire Department recommends that the applicant
install an auto�natic fire sprinkler systern fro�n a water supply capable
of ineeting minimtnn hydraulic standards of the Fire Department

6. 7.'he applicant shall apply for necessary building permits, pay additional
fees and call for necessary inspections within 3 months of Planning
C�mission approval. Credit may be given for work completed under the
original building permits.
7. Certification of existing construction by a private inspector (to be
approyed by the city) must be undertaken, reviewed and approved by the
City before issuance of a permit of occupancy.
Public Works Departme�nt Conditio�s
8. Within 6 months of Planning Com�nussion approval or at close of escrow,
whichever is more restrictive, the applicant shall raise the existing
low point in the curb, gutter and sidewalk and pave to conform to city
standards .
