WHII2FAS, the Planning Corimission of the City of Arroyo Grande has held a
public hearing on Parcel Map Case No. 89-488 in accordance with Chapter 3 of
the Subdivision Ordinance of the City of Arroyo Grande; and
WH��EAS, the Planning Comnission has found that this project is
consistent with the General Plan and the Environmental Doctunents associated
therewith; and
WHII2E�S, a Negative Declaration with mitigation measures has been
declared under the provisions of the California E7ivironmental Quality Act
(CEQA}; and
Wf�lEAS, the Planning Comnission hereby directs the Secretary to file a
Notice of Determination; and
WI�Q22EAS, said Parcel Map was referred to the Planning Comnission, by
various City Departments and the Staff Advisory Comnittee; and
W��S, the Planning Conmission finds, after due study, deliberation
and public hearing, the following circw�nstances exist:
1. The proposed map, design and improve�rnents of this subdivision are
consistent with the General Plan map and text because the General Plan
designation for this site is Office Professional and the proposed lot
sizes and uses are consistent with that designation. The proposed map
will be consistent with the Parks and Recreation Elesnent of the General
Plan because the conditions of approval require the dedication of the
creek and 10 feet frarn the top of the bank to the City.
2. This site is physically suitable for the proposed type and den�,ity of
development because minimi.un lot dimensions and areas can be provided.
3. The proposed subdivision design is not likely to cause substantial and
considerable damage to the natural environment, including fish, wildlife
or their habitat because adequate mitigation measures have been included
in the conditions of approval for the project.
4. The proposed design of the subdivision or proposed improvements are not
likely to caL�e public health problems.
5. The proposed subdivision design will not conflict with public easements
within or through the site because candition�, of approval have been
included which require dedication of necessary easements.
NOW, Tf�.TtEF�ORE, BE IT RESOLVID that the Planning Crnlmission of the City
of Arroyo Grande hereby approves said Parcel Map Case No. 89-488 subject to
the following conditions.
CONDITIONS OF APPROVAL:
Mitigation Measures
l. A Negative Declaration with Mitigation Measures has been prepared for
this project. All mitigation measures as outlined in the Conditions of
Approval shall be implemented and monitored by appropriate City
Departments and other responsible agencies. Verification in writing
that mitigation measures have been implemented shall be provided by tr,e
monitoring department.
2. In the event that during grading, construction or development of the
project, any archaeological resources are uncovered, all work shall be
halted until the City has reviewed the resources for their significanc.e.
If hwnan burials are encountered, the County Coroner (549-4513) shall be
contacted imnediately. The applicant may be required to provide
additional archaeological studies and/or mitigation measures. All
grading and improvement plans shall be noted to reflect said conditior,.

3. Al1 grading, excavation and tree root removal shall be monitorzd by a
Chw-nash Native American.

4. Prior to i�suance of any permits for construction on Parcel 2, the
applicant shall sul�nit a grading, drainage and erosion control plan,
pr�pared by a registerecl civil engineer, to tY�e Public Works Director
for approval. Said plan shall mitigate any potential impacts caused by
wind or water erosion that are a resuli: of construction.

Parcel 2.
5. Prior to pouring concrete for construction,of any structure on these
lots, the developer shall provide the Building Department with a
certificate of flood elevation for the proposed structure, indicating
that the floor elevation of said structure is above the flood hazard
zone. Said certificate shall be prepared by a licensed land surveyor.

Time Frame: Prior to pouring concrete for slabs or foundations of
any structure on these lots.
6. All construction on parcel 2 shall utilize fixtures and designs which
�snirnize water usage. Such fixtures and designs shall include, but are
not limited to, low flow shower heads, water saving toilets, instant
water heaters or hot water recirculating systems, drip irrigation with
drought tolerarit landscaping and etcetera. CC&R's or deed restriction�,
which shall require the above, shall be reviewed by the Planning
Dzpartment and the City Attorney, and recorded prior to, or concurrently
with the parcel map.

7. The applicant shall ascertain and comply with all state, county and cit�-
requirements, as are applicable to this project.
8. Development shall occur in substantial conforn�zce with the information
sukxnitted to the Planning Cormu ssion at the meeting of July 17, 1990 and
rr�arked "Exhibit A".
9. Approval of this tentative rt�p shall invalidate a�zd rescind tent�tive
parcel map No. AG 88-102.

10. All development shall meet the requirements of the PC zone, unless
otherwise approved.
11. Pursuant to Implementation Measure 2.11(g) of the Parks and ReCreation
Element of the General Plan, and Section 9-3.507(18) of the City
subdivision Ordinance, the developer shall dedicate to the City all that
arca of the stream bed and ten feet back of the stream bank. Said
dedicution shall take place concurrently with recordation of the parcel
map.
12. The developer shall stripe a bike lane along Fair Oaks Avenue frontage
per the General Plan, prior to recordation of the parcel map.
Improvements can be constructed after recordation of the parcel map with
appropriate bonding.

i3. Th� applicant shall design and construct street improvements on the I'air
Oaks Avenue frontage of the Parcel Map prior to recordation of the
narcel map. Improvements shall include, but are not limited to; curb,
gutter, sidewalk and paving confo1 Plans shall Prepar2d and
sicJned by a Civil �gineer, registered in the State of Califorriia.
Improvements can be constructed after recordation of the parcel map with
appropriate bonding.

14. Existing curb, gutter, sidewalk and pavement along Halcyon Road and Fair
Oaks P,venue shall be repaired or replaced as directed by the Public
Works Director, prior to recordation of the parcel map.
15. The applicant shall dedicate to the City 15 foot wide sewer easement
along existing 14" sewer main or relay new 14" sewer main to existing
sewer easement, prior to recordation of the parcel map.
16. The applicant shall dedicate to the City the water and storm drain
easement, prior to recordation of the parcel map.
17. The applicant shall dedicate to the City a 20 foot radius curve return
on the northeast corner of Halcyon and Fair Oaks Avenue for street
improvement, prior to recordation of the parcel map.
18. The applicant shall install street lighting along Fair Oaks Avenue
property frontage to PG&E standards, prior to recordation of the parcel
m3p. Improv�nents can be constructed after recordation of the parcel
map with appropriate bonding.
PARIC.S AND R�C�ZFATION D�A1rII�I�I'P
19. The eucalyptus grove adjacent to Fair Oaks shall be preserved.
20. If Woodland Drive Extension is not to be connected to Fair Oaks Avenue,
the applicant shall provide a recreational trail and bikeway easement
and improvements fran Woodland Drive Extension to Fair Oaks Avenue. The
eas�nerit shall be located at the northerly property line, along the
storm drain easemP.nt, fram Woodland Drive Extension to the creek and
shall be a minimwn of 12 feet wide in this location (the easement may
divert from the storm drain easement and the northerly property line at
its junction with the easement along the creek). From the northerly
property line to Fair Oaks Avenue along the creek, the easement shall be
a minim�un of 30 feet wide beginning at the westerly boundary of the 10
foot top of creek dedication. Ir�rovements shall include a 6 to 12 foot
wide canstructed of solid or grass crete pavers bicycle/pedestrian path
and a recreational trail constructed of deca�osed granite or a similar
material. Exact widths and locations of the paths shall be subject to
review and approval of the Parks and Recreation Director and the
Planning Director prior to recordatio� of the parcel map. Irnprovest�ents
can be constructed after recordation of the parcel map with appropriate
bonding.
