PC R 90-1288RFSOLUTI�I NO. 90-1288 499 A RESOLUTION OF � PI�1�iING �4ISSION OF � CITY OF ARROYO QZANDE APPR()VING SIQd (�SE NO. 89-90, APPLIID FOR BY ULTRAMAR ( Bg100N OI L CJ�g'ANY ) AT 610 C�2AND AVIIVUE F(�t A PLANNID SIQd PROGRAM WI�2FAS, the Planning Com�mission of the City of Arroyo Grande has considered an application for a Planned Sign Program to install signs at 610 Grand Avenue in the C-2 General Coarmercial District; and Wf�RFAS, the Planning Corncnission has fo�d that this project is consistent with the General Plan and the �ivironmental Doctunents associated therewith; and WI�RFAS, the Planning Coartnussion has reviewed this project in co[npliance with the California �vironm�eaztal Quality Act (CEQ�,) and has deternuned that this project is exempt per Section 15311 of the CEQ� Guidelines; and Wf�I2EAS, the Planning Co�mussion finds, after due study, deliberation and public hearing, the following circLmtstances exist: 1. The proposed signs are consistent with the intent and purpose of Section 9-4.2407 of the Zoning Ordinance as it relates to Planned Sign Programs. 2. Signs are visually coanpatible with the buildings they identify by utilizing materials, colors, or design motif inclu�led in the bui 1 ding . 3. Proposed signs ca�rrple�nent other existing or proposed signs on the site by using corrmon design ele�nents, such as materials, letter style, colors, illtunination, sign type or shape. 4. Proposed signs are co�npatible with surrounding land uses and will not obscure adjacent canforming signs. FTf��FAS, this project was reviewed by the Planning Co¢mlission and various City departments and found to be acceptable and in confotmance with the applicable codes and ordinances. The applicant shall ascertain and coniply with all State, County and City requirements as are applicable to this project. 2. DeveloprY�ent shall occur in substantial confornnance with the plans presented to the Planning Co�Ymission at the meeting of April 17, 1990 and marked "Exhibit "A". Planning Department Coan�ditio�s 3. Development shall conform with the C-2 zoning require�nents, unless otherwise approved. 4. Prior ta issuance of building permits, the applicants shall furnish a landscape and irrigation plan for the planter around the montunent sign, to the satisfaction of the Parks and Recreation Director. Carr Planning Co�rnussion Secretar Chairn�i ,.„,,�"'� J ATTACHMENT "A" STATEMENT OF SI�NIFICANT ENVIRONMENTAL EFFECTS AND MITIDATION MEASURES BACKGROUND The California Environmental Quality Act ("CEQA") and the State CEQA Guidelines promulgated pursuant thereto provide: "No public agency shall approve or carry out a project for whi.ch an Environmental Impact Report has been completed and which identifies one or more significant environmental effects of the project unless the public agency makes one or more written findings for each of those significant effects, accompani.ed by a bri.ef explanation of the rati.onale for each finding." (Section 15091) The City Council of the City of Arroyo Grande propose to approve the general plan update of the Land Use (LUE), Housing (HE), Open Space and Conservation (OSCE) Elements. Because the proposed action constitutes a project under CEQA and the State CEQA Guidelines, the City has prepared an Environmental Impact Report ("EIR"). The EIR identifi.ed certain significant effects that may occur as a result of this project. Further, the City Council has determined that the EIR is complete and has been prepared in accordance with CEQA and the State CEQA Guidelines. Therefore, the following findings are set forth herein pursuant to Section 15091 of the CEQA Guidelines. I. WATER A. Effect: The proposed General Plan Update would result in increased demand for domesti.c water over existing use. The updated Land Use Element, however, reduces water demand compared to the existing Land Use Element. B. Mitiqati.on: Of the five alternatives presented in the Environmental � Impact Report, the "lower density alternative" has been selected. The following Land Use, Housing and Open Space and Conservation Element objectives and policies mitigate water impacts: LUE Objective 8.0, LUE Poli.ci.es 8.1 and 8.2; HE Policy 14; OSCE Objectives 2.0 and 3.0; OSCE Policies 1.4, 2.1 - 2.4, and 3.1 - 3.3. The City would be able to prevent significant impacts to water resources by investigating potential new sources of water for domestic uses. If no new sources are procured, the City will limit approval of new development(s) so as to not overburden available water resources. This will be accomplished with a Resource .Management Ordinance that is to be adopted within six months of certii�cati�on of the EIR. C. Findinqs: Changes or alterations have been required in or incorporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. Statement of Facts: The Resource Management Ordinance will limit the number of dwelling units to the amount of available water, therefore, ensuring that the City has enough water for its citizens until additi.onal suppli�es are located. II. NOISE A. Effect: Increased traffic will generate corresponding increases in local noise. Continuation of agricultural actiqiti.es and growth on non- residential uses will also increase local noise levels as the City builds out. B. Miticaation: As growth occurs in the City, care should be exercised to exert proper planning on circulation routes and land uses so that acceptable noise levels are maintained. Developments may be required to provide noise or acoustical studi.es to identify noise impacts and mitigation measures. LUE Objective 7.0 and Policy 7.1 require adequate buffers between land uses. Street widths shall be planned and constructed to prevent unacceptable noise impacts to adjacent land uses. Appropriate constructiAn practices and materials may be required on development projects where potential noise impacts are projected. The City may develop special ordinances to address particular types of land uses that produce unacceptable noise levels. The City will revise the Noise Element based on information generated by the new Circulation Element. C. Findincrs: Changes or alterati.ons have been required in or incorporated into, the project which avoid or substantially lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts updated. The Noise Element is in the process of being III. POLICE/FIRE A. Effect: Buildout of the City to the level proposed in the "lower density alternative" land use plan will require an increase in police officers and firefighters. Buildout of the General Plan will incrementally increase the amount and type of hazardous materials within the City. B. Mitiqation: The following Land Use Element objectives and polici.es mitigate crime/fire protecti.on and hazardous materials impacts by maintaining adequate land for future publi.c facilities, requiring safe urban design, reviewing development projects for impacts and requiring appropri.ate on- and off-site improvements, and limiting locati.on of hazardous materials: Objective 5.0, Poli.cies 4.1, 5.1, 6.4, and 8.2. C. Findinas: Changes or alterations have been required in or incorporated into, the project which avoid or substanti.ally lessen the significant environmental effect as identified in the final EIR. Attachment "A" Page 2 D. Statement of Facts: The City has in the past increased the size and strength of the Poli.ce and Fire Departments as necessary and is expected to do so in the future. IV. AIR QUALITY A. Effect: The land use proposed within the study area, as shown on the Land Use map will generate significant impacts on the local air basin. B. Mitiqation: Of the five alternatives presented in the EIR, the "lower density alternative" has been selected. The following Open Space and Conservation Element objectives and poli.cies mitigate impacts related to air quality by proposing energy conservati.on measure that reduce electricity and natural gas use and other general measures to control pollutants: Objectives 6.0 and 7.0, Policies 6.1 - 6.4, 7.1 - 7.5. C. Findings: Changes or alterations have been required in or incorporated into, the project whi.ch avoid or substantially lessen the significant environmental effect as ident,ified in the final EIR. D. Statement of Facts: The majority of air quality problems experienced within San Luis Obispo County relate to vehi,cular trips. The City will comply with the Air Quality Attainment and Maintenance Plan currently being prepared by the San Luis Obispo County Air Pollution Control Distri.ct. V. RECREATION A. Effect: The Parks and Recreation Element indicates that by 1998 the City will have a 20-acre deficit in parkland. B. Mitigation: As long as the facilit.i.es/programs identified in the Parks and Recreation Element are implemented as proposed, there should be no significant impacts. LUE Poli.cy 2.6 and OSCE Policies 2.2 and 5.1 are consistent with the Parks and Recreation Element. C. Findings: Changes or alterati�ons have been required in or incorporated into, the project whi.ch avoid or substantia].ly lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts The Parks and Recreati�on Element outlines actions to mitigate parks and recreation impacts based on a populati.on of 19,378. The buildout of the Land Use Element is projected to be less than this population. VI. TRAFFIC A. Effect: Development occurring pursuant to the General Plan will increase traffi.c volumes both on a citywide and regional basis. Vari.ous roadway improvements will be necessary in order to accommodate projected traffic volumes. Attachment "A" Page 3 B. Mitiqation: The improvements identif�,ed in the Environmental Impact Report will be included in the Circulation Element. The Circulation Element will also identify phasing and funding for these improvements to prevent significant circulation impacts. In addition, development in areas with deficient roadways will be limited until adequate improvements can be made (LUE Objective 8.0). The City will coordinate future planned roadways with appropriate agencies (LUE Objective 9.0). C. Findinqs: Changes or alterati�ons have been required in or incorporated into, the project whi.ch avoid or substanti.ally lessen the significant environmental effect as identified in the final EIR. D. Statement of Facts: The Circulati.on Element will be updated following adoption of the Land Use Element in order to be consistent. VII. INFRASTRUCTURE A. Effect: Proposed uses would result in the increased coveraqe of the area with impervi.ous surfaces resulting in increased speed and volume of runoff. Additionally, portions of the project area are exposed to flooding from local drainage channels. The proposed project would result in increased wastewater flow and increased demand on the project areas sanitation systems. B. Mitiqati.on: Measures that help reduce domestic water use will also help reduce the production of wastewater. Therefore, the mitigation measures proposed for water consumpti.on are also applicable to wastewater. In addition the City will coordinate with sanitation district to assure adequate wastewater treatment capacity will be maintained to support development of the City. The master plan for flood control will identify funding and phasing for ident,i.fied improvements. All development plans will be reviewed by the City Engineer to assure that adequate flood control measures are constructed as needed. City staff will coordinate with County staff to assure that planned growth is consistent with the County Solid Waste Management Plan. C.
