T'he proposed use is consistent with the General Plan's statarients and intent as outlined in the Single Family Residential District. 2. The site is adequate in shape or size for the proposed use, as it can meet all setbacks and parking recYuir�alts. The parking requirem�its will be met because of the conditions of approval that tiave been placed on the project regarding parkinq. 3. The site does have adequate access. 4. The proposed use will not have an adverse effect on the use of surrownding property because sufficient separatian has been provided between uses, and adequate services are available. 5. T'he design and layout of the proposed use is suitable because the required setbacks, lot coverage, and other requiranents of the R- 1 Zone ancl of Article 40 of the Zoning Ordinance have been met. FggRFAS, this project was reviewed by the Plaruzing CoRmission and various City departme.nts and found to be acceptable and in conforrnance with the applicable codes and ordinances. NC�I, TE�ORE, SE IT RFSOLVID that the Planning Co�mussian of the City of Arroyo Grande does hereby approve said Conditional Use Perntit, subject to the following conditions: Gez�eral Caand.itians 1. The applicant shall ascertain and co�nply with all State, County, and City require�nents as are applicable to this project. 2. Development shall occur in substantial conformance with the plans presented to the Plaruiing Carrnission at the meeting of March 6, 1990, and marked Exhibit "A". Planning Departnr�nt Coanciitions 3. Developrrient shall conform with the R-1 zoning requirements, unless otherwise approved. 4. The applicant shall record a deed restriction and an Agreerr�nt Affecting Real Property regarding the second dwelling unit in accordance with the provisians of Article 40 of the Zaning Ordinance and to the satisfaction of the City Attorney and the Planning Director, within six (6) months of Planru.ng Camtission approval. 5. The applicant shall construct a fully enclosed single car garage to conform to the parking requirements of Article 40 of the Zoning ordinance, within six (6) moriths of planning Cormu.ssion approval or prior to final occupancy, whichever carnes first. - � ` : Building D�partmezit Co�ulitia�s 6. The garage shall be located to allow adeguate light and ventilation to the living area. 7. The applicant shall apply for necessary building permits, pay additional fees, and request necessary inspections within 3 months of Planning Corrmission approval. The applicant shall protect the existing 12" oak tree from damage that can be caused by equipment and building supplies. 479 9. The applicant shall keep drainage basin a minim�aT► of 20' away fran 12" oak t n,mk . 10. 'I"he roots of the 12" oak are to be protected during the grading of the retention basin. In the event that roots are discovered, the digging of the basin should be done by hand or by raking. Public Works Departmmennts Caaulitioms 11. The applicants shall su}�ni.t, for approval of the Director of Public Works, a grading and drainage plan prepared by a registered Civil Engineer prior to issuance of any further permits on the aite. Necessary gradinq and im�rovements �hall be campleted prior to final occupancy.
