The proposed use is coa�sistent with the General Plan's statemP.nts and intent as outlined in the R-1 Zone. The site is adequate in shape or size for the proposed use, as it can meet all the setback and parkinq requirements. Z'he site does have adequate access. The proposed use will not have an adverse effect on the use of surrounding property because sufficient separatio� has been provided between uses, and adequate services are available. The design and layout of the proposed use is suitable because the required setbacks, lot coverage, and other requirements of the R-1 Zone and of Article 40 of the zoninq ordinance have been met. �FAS, this project was reviewed by the Planning Co�mussion and various City departments and found to be acceptable and in conforn�ance with the applicable codes and ordinances. NC�T, Tf�'O�2E, BE IT RFSOLVF� that the Planning Co�mission of the City of Arroyo Grande does hereby approve said Conditional Use Permit, subject to the following conditions: General Co�ditio�s 1. � The applicant shall ascertain and canply with all State, County and City requi.re�its as are applicable to this project. DeveloFxnent shall occur in substantial conform with the plans presented to the Planning Co�mission at the meeting of February 20, 1989 and marked "Exhibit A". Planni nc7 DePartment Conditioa�.s 3. Developrnent shall conform with the R-1 zoning requirements, unless otherwise approved. 4. The applicant shall record a deed restriction and an Agree�alt Affecting Real Property regarding the second dwelling unit in accordance with the provisions of Article 40 of the zoning ordinance and to the satisfaction of the City Attorney and the Planning Director, prior to final occupancy. 5. The applicant shall dedicate an easement for creek bank maintenance and access fro�n the northerly property line to ten feet (10') south of the top of creek bank. Said easement shall be recorded prior to final occupancy. 47"1 6. The applicant shall maintain a minimn.un 18.5 foot setback frocn the top of creek bank to the closest point on the second unit or its attached garage. If it is possible �to maintain the required separation between structures, this setback shall be increased to 20 feet. 7. The driveway shall be enlarged in front of, and to the west of the existing two car garage in �order to allow adequate access to the second residential unit when cars are parked in frorit of the two car garage. Prior to final occupancy the applicant shall register the Redwood tree (labeled as an Elm tree on plan), Pine tree behind the existing garage, and Coral tree in front yard pursuant to the City Lanchnark Tree Program.
