CONDITIONAL USE PERMIT CASE N0. 89-451, APPLIED FOR BY

RECOPII�IENDING ADOPTION OF A NEGATIVE DECLARATION
IIHSREAS, the Planninq Commission of the City of Arroyo Grande has
considered an application for construction of a 638 square feet Second Dwellinq
Unit located at 189 Deer Trail Cir.cle, and
NHEREAS, the Planninq Commission has found that this project is consistent
With the General Plan and a Neqative Declaration has been declared under the
provisions of the California Environmental Quality Act (CEQA); and
i�HEREAS; the Planninq Commission finds, after due study, deliberation and
public hearinq, the followinq circumstances exist:

The proposed use is consistent with the General Plan's stateroents and
intent as outlined in the Planned Development zone.
The site is�adequate in shape or size for the proposed use, as it can meet
all the setback and parkinq requirements.
The site does have adequate access.
The proposed use will not have an adverse effect on the use of surrounding
property because sufficient separation has been provided between uses,
adequate services are available.
The desiqn and layout of the proposed use is suitable because the required
setbacks, lot coveraqe, and other requirements of the PD zone and of
Article 40 of the zoning ordinance have been met.
NOM, TflEREFORE, BE IT RESOLVED that the Planninq Commission of the City of Arroyo
Grande hereby recommends approval of said Conditional Use Permit with the
folloirinq conditions: ,
PLANNING DEPARTMENT
1. Development shall occur in substantial conformance to the plans
approved by the Planninq Commission at the meetinq May 2, 1989 and
included in Exhibit A.
2. The applicant shall record a deed restriction and an Aqreement
Affectinq Real Property regardinq the second dNellinq unit in
accordance with the provisions of Article 40 of the zoninq ordinance
and to the satisfaction of the City Attorney and the Planninq
Department, prior to occupancy of the second dWellinq unit.

3. Prior to final occupancy the owner shall plant two 15 gallon Quericus
Ilex (Holly Oak) trees alonq the street easement. Trees shall be
planted 7 feet in from curb and 30 feet apart.

Prior to issuance of all gradinq permits, the applicant shall mark
all trees to be removed with the approval of the Parks and Recreation
Director.
The applicant shall aqu.ire approval from the Architectural Control
Committee of "Oak Park Acres" prior to issuance of building permits.

the following roll call vote, to wit:
