PC R 89-123040�� RESOLUTION N0. 89-1230 A RESOLUTION OF THE PLANNING COMMISSlON OF THE CITY OE ARROYO GRANDE APPROVING CERTIFICATE OF COMPLIANCF CASE NO. 89-475(CC3, 528 CROWN HILL (RICHMOND A. AND SANllRA K. MITCHELL) i�HEREAS, the Planninq Commission of the City of Arroyo Grande has considered Certificate of Compliance Case No. 89-475(cc) in accordance with the Subdivision Map Act of the State of California; and WHEREAS, the Planning Commission has found that this project is consistent with the Environmental Documents associated therewith, and a Negative Declaration has been declared under the provisions of the California Environrnental Ouality Act (CEQA); and WflEREAS, the proposed subdivision design is not likely to cause substantial and considerable damage to the natural environment, iiicluding fish, wildlife or their habitat; and FIHEREAS, said Parcel Map was referred to various City Departments and the Staff Advisory Committee for recommendations. NOW, TAEREFORE, BE IT RESOLVED ttiat the Planninq Commission of the City of Arroyo Grande hereby approves said Certificate of Compliance Case No. 89-475(cc) and adopts a Negative Declaration on the project subject ta the followinq conditions: Planning Department 1. Any construction on this lot shall coR�ply with the City's subdivision, zoning, and other ordinances in effect at the time of construction. 2. Due to the existence of an.easement for a patio structure across the rear of this lot and in compliance with the lot coverage requiren�ents of the R-1 zone, the maximum area of this lot to be covered by buildings and structures (not including the patio structure in the existing easement, future patios or swimming pools) shall not exceed 1167 square feet.except in the case wherein the patio structure is removed and the easement canceled, then the maximum coverage for this lot shall not e�ceed 1772 square feet. 3. Any construction on this lot shall not exceed the heiqht limitations in effect, in this zone, at the tirne of issuance of building pern�its. 4. A conditional certificate of compliance shall be recorded, concurrently for Lot 4 in Block 26 of the aforementioned subdivision. On motion of Couunissioner Soto, seconded by Commissioner Flores, and by the following roll call vote, to wit: AYES: Com[nissioners Moore, Soto, McCann, Gallayher, Flores and Chairmar► Gerrish NOES: None ABSENT: Cornmissioner Scott Tlie foreqoing Resolution was adopted this 21st day of March, 1989.
