A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARROYO GRANDE, CALIFORNIA, RECOMMENDING THAT THE CITY
COUNCIL IHPOSE A KORATORIUM ON CERTAIN LAND DIVISIONS,
ARCHITECTURAL REVIEW, ZONE CHANGES, BUILDING PERMITS,
OPTIONAL DESIGN STANDARD AND CONDITIONAL US�: PERMITS
WITHIN AREAS DESIGNATED ON THE GENERAL PLAN FOR
MEDIUM-HIGH RESIDENTIAL (14 DWELLING UNITS PER ACRE)
AND AREAS ZONED FOR R-3 PURSUANT TO SECTION 65858
OF THE CALIFORNI� GOVEItNlIENT CODE.
iVHEREAS, the City of Arroyo Grande is considering or studying, or intends
to study in the near future, a qeneral plan of development and zoning ordinac�ce
for the city, hereinafter referred to as "the General Plan"; and
KHEREAS, it is reasonably expected that the General Plan and the zoriinq
ordinance will be completed within approximately one year; and
WHEREAS, many of the areas designated for Medium-High Density Residential
and zoned R-3 are in proximity or within areas which may be.considered for lower
density uses; and
WflEREAS, the continued qrantinq of land divisions, optional design
standard, architectural review, building permit, conditional use permits and
rezoninq applications. within tl:e areas desiqnated for Medium-High Density
Residential and zoned R-3 may be inconsistent with the policies and standards
incorporated in the General Plan for the City; and
WHEREAS, a deferral of further land divisions, optional design standard,
conditional use permits, architectural review and rezoning within the areas
designated for Medium-High Density Residential and zoned R-3 pendiny completion
of the General Plan and Zoning Ordinance enable the City of formulate reasonable
policies and standards in the General Plan and Zoning Ordinance which will allow
orderly land development within the City, includinq the areas designated for
Medium-High Density Residential,and zoned R-3; and
WHEREAS, such deferral of land divisions, conditional use permits, building
permit, architectural review and rezoning within the areas designated for Medium-
High Density Residential and zoned R-3 are also necessary to mitigate and prevent
adverse impacts on existing and future residents, to assist in proper plan�iing
for public facilities, and to permit the proper planning for roads, utilities
and other infrastructure needed for orderly development; and
�IHEREAS, the foreqoinq reasons demonstrate that there exists a current,
immediate and continuing threat to the public health, safety or welfare if land
division, architectural review, conditional use permits, building permit, the
use of Optional Desiqn Zoniiig and rezoning applicatioiis are continued to be
approved within the areas designated for Medium-High Density Residential and
zoned R-3, pursuant to the existinq qeneral plan and zoning of developri�ent for
the City;
NOW, TflEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARROYO GRAND� DOES
RESOLVE AS FOLLOWS:
1. The Planninq Commission hereby respectfully recommends that, pursuant
to Section 65858 of the California Government Code, the City Council
impose a moratorium on land divisions, optional design standard,
conditional use permits, building permit, architectural review and
rezoning applications within the areas designated for Medium-High
Density Residential and zoned R-3 pending completion of the General
Plan and zoning ordinance, as follows:

No zone change applications shall be processed;
No applications for land divisions shall be processed;
No architectural review applications shall be processed;
No conditional use permit applications shall be processed;
No building permit shall be issued; and
No further processing of Optional Desiqn Zoning applications;

2. The Planning Commission hereby respectfully further recommends that.
the City Council approve such steps as may be required to expedite
the update of the General Plan and Zoning Ordinance;
WHEREAS, projects proposed for Medium-High Detisity and R-3 zone are often
submitted persuant to outmodel Optional Design provisions in the Zoning Ordinance
which were enacted prior to Current Planned Development, use permit and varianee
regulations, which provide for rnore uniform regulation alid administration, and
the city intends to study whether said Optional Design provision shotild be
repealed or updated.
On motion of Commissioner Moore, seconded by Commissioner Olsen, and on
the following roll call vote, to wit:
AYES: Commissioners Olsen, Moore, Boqqess and Chairman Soto
NOES: Commissioners Gerrish, Flores and Scott
ABSENT: None
