PC R 88-1209377 R,F50LUTION NO. �88-1209 A RFSOLUTION OF THE PLANNING OOMMISSION OF THE C1TY OF ARROYO GRANDE GRANTTNG A VARIANCE, CASE NO. 88-132, APPLIED FOR BY JOHN VERDIN AT 904 MAGNOLIA STRF.F.T. WHEftEA.S, the Planning Carmission of the City of Arroyo Grande hns consi�ered Variance Application No. 88-132, filed by John VecYlin, for a Variance to construct a six (6) foot tiigh wall along Halcyon Road at 904 Magnolia Stt�eet in the "R-1" Single Family Residential District; and WHEREAS, the Corrrrussion has held a public hearing on this application in accordance with the CYty Cale; and WHERF.AS, the Carrmission finds that the following circurr�stances exist: 1. That the adjus�nent authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated; 2. That becat�e of special circiar�stances applicable to tr�e subject property, including size, . shape, topography, location, or surroundings, the strict application of the provisions of this chapter is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications; 3. That the granting of the Variance will not be contrary to the intent of this chapter or to the public safety, health and welfnre; 4. That due to special conditions or exceptional characteristics of the property or its location, the strict application of the provisions of this chapter would result in difficulties and unnecessary hardship; NOW, THER.EFOR,E, BE 1T RF50LVED that the Planning Corr�russion of the G�ty of Ar�royo Grande hereby approves said Variance subject to the foIlowing conditions: 1. An eight to ten foot wide gate be provided along the site's northern portion, providing �ccess to the Public Utility E�sement (P.U.E.) subject to the approval of the Public Works Director. 2. Prior to finalizing the fence, the applicant shall provide a landscape plan indicating the treatment of the area between the proposed fence and the neighboring property to the north. 3. The applicant sr�ll provide the Building Department with engineering documentation of the wall's integrity, including the portion already constructed. On motion by Con�rrussioner Flores, seconded by ConTr�issioner Boggess, and by the following roll call vote, to wit: AYES: Carrrrassioners Flores, Boggess, Moore and Scott NOFS: Carr�iissioner Olsen and Chairman Soto ABSENT: Ca�missioner Gerrish the foregoing Resolution was adopted this 15th day of November, 1988.
