PC R 88-1182344 R}��OLUTION NO. 88-ll82 A RFSOLUTION OF 'IHE PLANNING OOMMIS'SION OF THE CITY OF AR.ROYO GR.ANDE GRANTING A VARIANCP, CASE NO. 88-130, APPI.IED FOR BY OAKCREST ESTATFS AT LOT 67, LA CRFSTA DRIV$ (E. DORPMAN) WHIItF.AS, the Planning Catmi�sion of the CSty of Arroyo Grande has consideced Variance Applicetion No. 88-130, filed by Oakccest Estates, for a Variance fran the rt�xIIrnan building height of 15 feet at Lot 67, La Ckesta Drive in the "ft-1" Single Family ftesidential District; t�nd WHEREAS, the Planning Camdssion has held a public hearing on this application in accordance with the Cty Code; and WHEftFAS, the I'lanning Conmission �inds that the following circurBtances exist: 1. That the adjustment authorized shall not constitute a grant of special privilege inconsistent with the ]anitations upon other properties in the vicinity and district in which the subject property is situated; 2. That because of speciel circur�stances applicable to the subject property, ineluding size, shupe, topography, location, or surroundings, the strict applieation of the provisions of this chapter is fotmd to deprive the subject ptbperty of privileges enjoyed by other properties in the vieinity and imder identical zone classi�cations; 3. 'I�at the granting of the Variance will not be contrary to the intent of this chapter or to the public safety, health and welfare; 4. That due to s�eciel conditions or exceptional characteri�tics of the property or its location, the strict application of the provisions of this chapter would result in difficulties and unnecessary hardship; 5. 1fie gr�nting of the Variance will not be materially detranental to other properties or land uses in the area becui,se the views ciu�rently enjoyed by the surrounding pmperties will not be signi�cantly impacted by the pmpos�.�d development; 6. There are exceptional or extraordinary circunstances applicable to the intended tse that do not apply to other properties in the same zone. The property has no apparent or significant viewsheds, nor does it appenr to affect surrounding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other properties in the vicinity or in the same zone because the 15-foot restriction would limit the buildable potential of the lot, and other parceLs in the area have been developed with two-story hames; and 8. The granting of the Veriance is compatible with the objectives, policies, and gener�l ]�ind uses specified in the General Plan becFn�se the intent of the urgency ocdinance is being met, as there is substantial protection of the viewsheds on adjacent properly, and the proposed develapment is in conforn�ance with the goaLs, policies and objectives of the General F�lan. NOW, THEREFORF, BE IT RFSOLVED that the F'lanning Camussion of the C.�ty of Arroyo Grunde hereby approves said Variance subject to the standnrd conditions of the C9ty and those listed below: 1. The development of the site shall occur in substantial conforn�ance with the approved plans.
