DORFMAN� � 343 WHERF.�S, the Plaiuiing Ccxrrnission of the G1ty of Arroyo Gi�nde has considered Variance Application No. 88-129, filed by Oakcrest Fstates, for a Variance fran the max�ium building height of 15 feet at Lot 66, La pesta Drive in the "ft-1" Single Family ftesidential District; and W�AS, the Planning Camiission has held a public hearing on this application in accordance with the (�ty Code; and WHERF.AS, the Planning Camu.SSion �5nds that the following circutrtances exist: 1. That the adjustrnent authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject Property is situated; 2. That becai�se of s�ecial cireur�tances applicable to the subject propertY, including $�ze� Shape, topography, location, or surroundings, the strict applicetion of the pt^ovisions oP this chapter is fow�d to deprive the subject property of privileg�s enjoyed by other properties in the vicinity and �der identical zone classifications; 3• That the gi�anting of the Varianee will not be contrary to the intent of this chapter or to the public sefety, health and welfare; 4. Ttuit due to speciel conditions or exceptional characteristics of the property or its 14cation, the strict application of the provisions of this chapter would result in dif$culties and tau�ecessaty herdstup; 5. The granting of the Variance will not be materially detrfrnental to other properties or land ises in the area becai.�se the views currently enjoyed by the surrounc�ing properties will not be significantly impacted by the propo5ed development; 6. �ere are exceptional or extraordinary circur�st.�nces applicable to the intended Lse that do not apply to other properties in the same zone. NOW, THEREFpRE, BE 1T ItFSOLVED that the Planning Canmission of the G7ty of Arroyo Grande hereby approv�s said Variance subject to the standard conditions of the Cfty and those listed below: 1.
