(E. DORFMAN) WH[E�tEAS, the Planning Carrmission of the C�ty of Arroyo Grande has considered Variance Application No. 88-126, filed by Oakcrest Estates, for a Variance fran the ma�dmum builcling height of 15 feet at Lot 63, Platino Lane in ttie "A-1" Single Family Residential District; and • WHEREAS, the Planning Gacrmi.ssion has held a public hearing on this application in acoordance with the �ty Code; and WHLREAS, the Planning Carrmission ffnds that the following circiar�stances exist: 1. That the sdjushnent authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and �strict in which the subject p�operty is situated; 2. 'I7�at becat�se of speciel ciretmstances applicable to the subject ptbperty, including size, shape, topography, location, or surrotmchngs, the strict application of the provisior� oP this chapter is Yound to deprive the subject property of privileges enjoyed by other properties in the vicinity tznd under ide�tical zone elessifi- catior� 3. 'I�at the granting of the Variance will not be contrary to the intent of this chapter or to the publie safety, health a�nd welfare; 4. That due to special conditions or exceptional chsr�eteristics of the property or its location, the strict application of the provisions of this chapter would result in dif�iculties and unnecessary harctship; 5. The granting of the Variance will not be materially detrfrnental to other properties or land uses in the ac�ea because the views currently enjoyed by the surrounchng properties will not be significantly impAeted by the proposed developrnent; 6. There are exceptional or extraordinary circunstances applicable to the intended use that cb not apply to other properties in the same zone. The property has no npparent or significant viewsheds, nor does it appear to affect svrrounding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other properties in the vicinity or in the same zone because the 15- foot re�stMetion would lirr�it ttie buildable potentiel of the lot, and other parcels in the arna have been developed with two-story hanes; and 8. The granting of the Variance is canpatible with the objectives, policies, and g�eneral land use.s specified in the General Plan beca�e the intent of the urgency ordinance is being met, es there is substantial protection of the viewsheds on adjacent property, and the proposed developrnent is in confomlance with the goe]s, policies and objectives of the General Plan. NOW, THEREFORE, BE IT It�OLVED that the P9anning Canni.ssion of the C7ty of Arroyo Grande hereby approves said Variance subject to the standard conditions of the C�ty and ttwse listed below: 1. The development of the site shall occur in substantial confom�anee with the approved plans.
