PC R 88-1176338 RL�ULUTION NO. 88- 1176 A RF'SOLUTION OF THE PLANNING OOMMISSION OF THE CI'I'Y OF ARROYO GRANllE GRANTING A VARIANCE, CASE NO. 88-124, APPi,IED FOIi BY OARCRFS'I' ESTATES AT LOT 60, PLATINO LANE. (E. DORFMAI� WHEREAS, the Planning Cbnmission of the G�ty of Arroyo Grande hes considered Variance Application No. 88-124, filed by Oakcrest Fstates, for a Variance fran the ma�dmun building height of 15 feet at Lot 60, Platino Lane in the "ft-1" Single Family Residential District; and � WHEREAS, the Planning Carmi.c�ion has held a public hearing on this application in accordance wlth the C�ty Code; and WHL'REAS, the Planning C.anmission �5nds that the following circunstances exi.St: 1. That the adjustment authorized shall not constitute a grant of special privilege incons3stent with the limitations upon other properties in the vicinity and � distcict in which the subject propeMy is situated; 2. That becatse of speciel circunstences applicable to the subject property, including size, shape, topography, locatton, or stu�rounclings, the strict application of the provisions of this chapter is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classi�- cations; 3. That the granting of the Variance will not be contrary to the intent of this chapter or to the public safety, health and welfare; 4. That due to special conditions or exceptional characteristics of the property or its location, the strict application of the provisions of this chapter would result in difffculties and unnecessary harctship; 5. The granting of ttie Variance will not be materially detrirriental to other properties or land uses in the area becau5e the views curtrntly enjoyed by the surrounding properties wIll not be signi�cantly impscted by the proposed development; 6. There are exceptional or extr�ordinary circurr�stances applicable to the intended use that do not apply to other properties in the same zone. T7ie property has no apperent or significant viewsheds, nor does it appear to affect surrounding viewsheds. 7. The strict application of the orc�nance deprives svch property of privileges . enjoyed by other properties in the vicinity or in the same zone becau�e the 15- foot restriction would liinit the b�ldable potentiel of the lot, and other parcels in the area have been developed with two-s�tory hanes; and 8. The granting of the Variance is canpatible with the objectives, policies, and general land ises speci�ed in the G�:neral P'lan because the intent of the urgency ordinance is being met, as there is substantial protection of the viewsheds on adjacent property, and the proposed develc�ment is in conforn�ance wIth the goals, policies and objectives of the General Plan. NOW, THEftIIrORF., BE TI' RFSOLVI7D that the PZanning Camvssion of the GTty of Arroyo Grande hereby approves said Variance subject to the standard conditions of the G�ty and those listed below: 1. The development of the site shall occur in substantial confomlance with the approved plans.
