RFSOLIITION NO. 88-
A RF50LUTION OF THE PLANNING OOMMISSION OF THE CITY
OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 88-122,
APPLIID POR BY JOHN AND CAROL TERRY AT 240 GULARTE ROAD
WHEREAS, the Planning Carmdssion of the Cfty of Arroyo Grande has considered
Variance Application No. 88-122, filed by John and Carol Terry, for a Variance fran the
maximum building height of 15 feet at 240 Gularte Road in the "R-1" Single Family Residential
District; and
WHEftEAS, the Planning Caimission has held a public heering on this application in
accocdance with the C�ty Code; and
WHEREAS, the P9arming Carmission �inds tt�at the following circurtistances exist:
1. That the adjustment authorized shall not constitute a gt�nt of special privilege
inconsistent with the limitations upon other properties in the vicinity and cbstrict
in which the subject property is situated;
2. That becatse of speciel circunstances applicnble to the subject praperty, including
size, sh�pe, topography, location, or surrotmdngs, _the strict application of the
provisions of this chapter is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and w►der id�tical zone classi�-
cations;
3. That the granting of the Variance will not be contrary to the intent of this
chaptec or to the public safety, health and welfare;
4. That due to special conditions or exceptional ch�racteristics of the property or its
location, the strict application of the provisions of this chapter would result in
difficulties and tmnecessary harci�hip; ,
5. The granting of the Variance will not be materially detrimental to other properties
or land u�es in the area beca�e the views cu�rently enjoyed by the s�.a�rounding
properties will not be signi�cantly impacted by the proposed development;
6. There are exceptional or extraorclinary ciretsr�stances applicable to the intended
u5e that do not apply to other properties in the same zone. The property has no
apparent or signi�cant viewstieds, nor does it appeur to affect s�rounding
viewsheds.
7. The strict application of the or�nance deprives such property of privileges
enjoyed by other properties in the vicinity or in the same zone beca�e the 15-
�foot restriction w�ould ]imit the buildable potential of the lot, and other parcels in
the area have been developed with two-story homes; and
8. The granting of the Variance is canpatible with the objectives, policies, and
general land uses speci�ed in the General Plan becat.�e the intent of the urgency
orcbnance is being met, as there is substantial protection of the viewsheds on
udjacent property, and the proposed developrrient is in confomtance with the go&]s,
policies and objectives of the General Plan. .
NOW, THEREFURE, BE IT ItESOLVID that the Planning Corrmassion of the Cfity of
Arroyo Grande hereby approves said Variance subject to the standard conditions of the GYty
and those listed below:
1. The developrnent of the site shall occur in substantial confom�ance with the plans
approved by the Planning C',arrrussion on A4ay 17, 1988.
