OF THE Cl'I'Y OF ARROYO GRANDE DENYING A VARIANCE� CASE NO. 88-121, APPLIED FOR BY ANNE ROBE1tTSON AT 292 GULAR.TE ROAD WHERLAS, the Planning Corrmission of the City of Arroyo Grande has considered Variance Application No. 88-121, filed by Anne Robertson, for a Variance from the maxinnun btulding height of 15 feet at 292 Gularte Road in the "R-1" Single Family ftesidentiel District; and VIIHEREAS, the Planning Conmo.�.sion has held a public hearing on this application in accordance with the City Code; and W��AEAS, the Planning (',orrmission �nds that the following cirewrrtances exist: 1. That the adjustment authorized shall constitute a grant of special privilege inconsistent with the limitations upon other properties in the viciruty and district in wtuch the subject property is situated; 2. That because of special cirewrrtances applicable to the subject property, including size, shape, topography, location, or surrounc�tings, the strict application of the provisions of this ehapter is found not to deprive the subject property of privileges enjoyed by other P�Pe� in the vicinity and under identical zone elassifications; 3. That the gcanting of the Variance will be contrary to the intent of this chapter or to the public safety, health and welfare; 4. That due to special conditions or exceptional characteristics of the property or its location, the strict application of the �rovisions of this chapter would not result in difficulties and unnecessary hardship; 5. The granting of the Variance could be materially detrimentel to other properties or land uses in the area because the views currently enjoyed by the surrounding propertles vvill be significantly impacted by the proposed development; 6. There are no exceptional or extraordinary circtur�stances npprlicable to the intended ise that do not apply to other properties in the same zone. 7. The strict application of the ordinance does not deprive such property of privileges enjoyed by other properties in the vicinity or in the same zones; und 8• The granting of the Variance is not compat�ble with the objectives, policies, and general land uses specified in the General Plan. NOW, THEREFORE, BE 1T RFSOLVED that the Planning Ca�nmission of the City of Arroyo Grande hereby denies said Variance.
