PC R 88-1168�30 RFSOLUTION NO. 88-1168 A RFSOLUTION OF TAE PLANNING OOMMISSION OF THE Cl'I'Y OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 88-120, APPLIED FOR BY FRANR AND OONNIE FREITAS AT 602 CERRO VLSTA LANE WHERF.AS, the Planning Co�rrrrission of the City of Arroyo Grande has considered Variance Application No. 88-120, filed by Frank & Connie Freitas, for a Variance from the ma�dnnun building height of 15 feet at 602 Cerro Vista Lane in the "R-1" Single Family Residential District; and WHERF.AS, the Conmission has held a public hearing on this application in accordance with the City Code; and WHLREAS, the Cormrission finds that the following circurrstances exist: 1. That the adjustrnent authorized shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated; 2. That because of special cirewrrtances appdicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the provisions of this chapter is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifi- cations; 3. That the granting of the Variance will not be contrary to the intent of this chapter or to the public safety, health and welfAre; 4. That due to special conditions or exceptional characteristics of the property or its location, the strict application of the provisions of this chapter would result in difficulties and unnecessary hardship; 5. The grantirig of the Variance will not be materially detrimental to other properties or land uses in the area because the views currently enjoyed by the s�u•rounding properties will not be significantly impacted by the proposed development; 6. There are exceptional or extraordinary circuir�tances applicable to the intended use that do not apply to other properties in the same zone. The property has no apparent or significant viewsheds, nor does it appear to affect surrounding viewsheds. 7. The strict application of the ordinance deprives such property of privileges enjoyed by other properties in the vicinity or in the same zone because the 15- foot restriction would limit the buildable potential of the lot, and other parcels in the area have been developed with two-story homes; and 8. The granting of the Variance is compatible with the objectives, policies, and general land uses specified in the General Plan because the intent of the urgency ordinance is being met, as there is substantial protection of the viewsheds on adjacent property, and the proposed development is in confocmance with the goals, policies and objectives of the General Plan. NOW, Z'HEREFOftE, BE 1T RF�OLVED that the Planning Comrrrission of the City of Arroyo Grande hereby approves said Variance subject to the standard conditions of the City and those listed below: 1. The development of the site shall occur in substantial conforn�ance with the plans approved by the Planning Corrarrission on April 19, 1988.
