A RFSOLUTION OF THE PLANNING OOMMLSSION OF THE
Cl'1'Y OF ARROYO GRANDE GRANTING A VARIANGE, CAS�E
NO. 88-119, APPLIED FOR BY MELV IN AND PEGGY
CALDWELL AT 565 WOODLAND DRIVE
WHEftEAS, the Planning Canmission of the City of Arroyo Grande has considered
Variance Application No. 88-119, filed by Melvin, & Peggy Calc]well, for a Variance from the
ma�dnnun building height of 15 feet at 565 Wood)and Drive in the "R-1" Single Family
Residential District; and
WHEREAS, the Conmi,s,sion has held a public hearing on this application in accordance
with the G�ty Code; and
WHF.�tF.AS, the C,orrmi,ssion finds that the following circurristances exist:
1. That the adjustrnent authorized shall not constitute a grant of special pri�nlege
inconsistent with the limitations upon other properties in the vicinity and district
in which the subject property is situated;
2. That because of special circurr�stances applicable to the subject pc�operty, including
size, shape, topography, location, or surrounclir�gs, the strict application of the
provisions of this chapter is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity And under identical zone classifi-
cations;
3. That the granting of the Variance will not be contrary to the intent of this
chapter or to the public safety, health and woelfare;
4. That due to special conditions or exceptional characteristics of the property or its
location, the strict application of the provisions of this chapter would result in
difficulties and tmnecessary herdship;
5. The granting of the Variance will not be materially detrimental to other properties
or ]and uses in the area because the views currently enjoyed by the surrounding
properties will not be signi�cantly impacted by the proposed development;
6. There are exceptional or extraordinary cirewr�tances applicable to the intended
use that do not apply to other properties in the same zone. The property has no
apparent or significant vievusheds, nor does it appear to affect surrounding
viewsheds.
7. The strict application of the ordinance deprives such property of privileges
enjoyed by other properties in the vicinity or in the same zone because the 15-
foot restriction would limit the buildable potential of the lot, and other parcels in
the area have been developed with two-story har�es; and
8. The granting of the Variance is compatible with the objectives, policies, and
general ]gnd uses specified in the General Plan because the intent of the urgency
ordinance is being met, as there is substantial pt�otection of the viewsheds on
adjacent property, and the proposed development is in conforn�ance Kzth the goals,
policies and objectives of the General P7an.
NOW, THER.EFOR,E, BE 1T RESOLVED that the P'lanning C�rmission of the Gfty of
Arroyo Grande hereby approves said Variance subject to the standard conditions of the City
and those listed below:
1. The development of the site shell occur in substantial confocTr�ance with the plans
approved by the P'lanning Commission on Apr�1 19, 1988.
