CASE NO. 88-117, APPLIED F08 BY BILL REINHART AT
1496 SIER.RA DRIVE.
WHEREAS, the Planning Conrrnssion of the City of Arroyo Grande has considered a
Variance application No. 88-117, filed by Bill Reinhart for a Variance ft�om the maximum
building height of 15 feet at 1496 Sierra Drive in the "R-1" Single Ferrvly Residential District;
and
WHEREAS, the Planning Carrni.ssion has held a public hearing on this application in
accordance with the GYty Code; and
WHER.EAS, the Planning Carrmi.�.sion �nds that the following circiurstances exist:
1. That the adjus�r�ent authorized shall not constitute a grant of special privilege
inconsistent with the limitations upon other properties in the vicinity and district
in which the subject property is situated.
2. That because of special cirew�tances applicable to the subject property, including
size, shape, topography, location, or svrroundirgs, the strict application of the
provisions of this chapter is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under identical zone classifications.
3. That the granting of the Variance will not be contrary to the intent of this
chapter or to the public safety, health and welfare.
4. 'I1�at due to special conditions or exceptional characteristics of the property or its
location, the strict application of the provisions of trds chapter would result in
difficulties and unnecessary hardship.
5. The granting of the Variance will not be n�aterially detrimental to other properties
or land uses in the Area because the views currently enjoyed by the surrounding
properties will not be significantly impacted by the proposed development.
6. There are exceptional or extraordinary cirewrstances applicable to the intended
use that do not apply to other properties in the same zone. 1fie property has a
section of significant slope and a unique access situation.
7. The strict application of the ordinance deprives such property of privileges
enjoyed by other properties in the vicinity or in the same zone because the 15-
foot restriction would limit the buildable potential of the lot, and other parcels in
the area have been developed with two-story horries.
8. The granting of the Variance is compatible with the objectives, policies, and
general land uses specified in the General Plan because the intent of the urgency
ordinance is being met, as there is substantial protection of the viewsheds on
adjacent property, and the proposed development is in conforrnance with the goals,
policies and objectives of the General Plan.
NOW, TIiEREFORE, BE IT RFSOLVED that the E'lanning Conmission of the City of
Arroyo Grande hereby approves said Variance subject to the standard conditions of the GYty
and those listed below:
1. The development of the site shall occur in substantial conformance with the
plans approved by the Planning Carmassion on Apr�1 5, 1988.
On motion by Carrrnssioner Soto, seconded by Carmd.�.sioner Olsen, and by the followirg
roll call vote, to wit:
