A RFSOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE, APPROVING USE PERMIT
CASE NO. 87-428, AT 405 AND 407 TRAFFIC WAY

WHEftEAS, the 1�'lanning CorrIInission of the CXty of Arroyo Grande has considered an
application for a Planned Unit Develop�nent at 405 and 407 �af�c Way in the "C-3" Highwa.y
Service District; and
WHEREAS, the Planning Corrgnission has fotmd that this project is consistent with the
General Plan and the Environmental Doctmlents associated therewith, and a ca.tegoricial
ex�nption has been declared imder the provisions of the California Environmental Quality Act
(C.E.Q.A.); and
WHEREAS the Planning Carm�ission finds after due study, deliberation and public
hearing, the following ciretur�stances exist:
1. The proposed tse is consistent with the General Plan and Zoning
Ordinance.
2. The site is adequate in shape or size for the proposed ise, as it can meet all the
setback and parking requir�nents.
3. The proposed Lse will not have an adverse effect on surroimding properties.
NOW, THEREFORE, BE 1T ftFSOLVED, that the Plaru�ing Conmission of the GYty of
Arroyo Grande hereby approves said use perrnit subject to the following conditions:
1. That the agreement with the adjoining property owner assuring 16'6"
drive access be submitted to the City Attorney, Pl�anning Director and the Fire Chief
for their review and approval. '
2. That both water and sewer services shall be supplied separately to each btrilcfing from
the front of the property in accordance with a plan submitted to and appt�oved by the
Director of Public Works.
3. That the applicants submit to the Planning Director and City Attorney a copy of a
proposed agre�nent or C.C. & R.'s establishing an entity which has as its purpose the
maintenance, upkeep and future improv�nent of all spaces in comnon to the lots in the
subdivision. Said agre�nent shall include requirements for equitable payment of
charges that are imposed upon the corm�on area. It will also include any standards
which are intended for signing, fencing or other improvements intended for the property
in the comnon area.
On motion by Corrxnissioner Soto, seconded by Carm�issioner Flores, and by the following
roll call vote, to wit:
