RESOLUTION NO, 1075
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 3 -
VERNON STREET.
WHEREAS, on the 13th day of November, 1973, th<2. City C~;'::mci: of thE:: City

the hour of 8:00 P.M, in the Council Chambers of the City HaD, 21':' Ease Branch
Streetj Arroyo Gra.nde, California, to ascertain whether public rWCdsBity~ l:e.alt1:'l,
safety or welfare requires the removal of poles, ove.rhsad wires a.nd associated
overhead structures, and the underground installation of wires and facilities
for supplying electric, communication, or similar or associated service~ with1~
that certain area of the City described below; and
WHEREAS, notice of such hearing has been given to all affected property
owners as shrn."I1 on the last equalized assessment roll and utilities concerned
in the manner and for the time required by law; and
WHEREAS, such hearing has been duly and regl'larly held, and all persons
interested have been given an cpportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARROYO
GRANDE AS FOLLOWS:
That, pursuant to Ordinance No. 71 C.S. of the City of Arroyo Grande, the
hereinafter described area is hereby declared an Underground Utility District,
and is designated as Underground Utility District No, 3 - Vernon Street, of the
City of Arroyo Grande. The area to be included in the Underground Utility
Dis trict is shown upcn that certain map entitled "Arroyo Grande UndergrJJnd
Utility District No, 3 - Vernon Street", dated October 29, 1973, which is on
file in the office of the City Clerk of the City of Arroyo Grande, California,
said area being more particularly described as foll~Ns:
In the City of Arroyo Grande, County of San Luis Obispo, State of
California, being that portion of Vernon Street as delineated on the
Map of The Valley View Tract recorded in Book 3 of Maps at Page 78,
records of said County described as follows:
Beginning at a point on the westerly line of Vernon Street,
said point being located 30' northwesterly of the southeasterly
corner of Lot 1 Block 3 of said Valley View Tract; thence at
right angles to Vernon Street and in a direct line across Vernon
Street to the easterly line thereof; thence northerly along the
eas t8rly line of Vernon Street to the northwes t corner of Lot 7,
Block 5; thence North 60. 35" West acr(~s Vernon Street to the
Westerly li,ne, of Vernon Street; thence southwesterly and s~jth-
easterly along the westerly line of Vernon Street to the point
of beginning.
BE IT FURTHER RESOLVED that the City Council does hereby fix that after
written notice and demand delivered to property owners, said affected property
owners moIst be ready to receive service within ninety (90) days from the effective
/late of this nsolution, and theCo-;Jncil ,does he-reoy order the removal by all
public utilities of all poles, "overhead "wires and associated overhead st.ructures
and the, underground installation of said wires an~ facilities for ~Ipplying
electric, communiC:l1t:!.on, or similar or associated service within ('ndergrcund
Utility District No, 3 - Vsrndn Street, ,on or before February 2.7, 1974,
BE IT FURTHER RESOLVED that ~he City Clerk is hereby instructed to notify
all affected utilities and all persons awning real property within Undergro~nd
Utility Distrtc:t No, 3 - Vernon' Street, of the adoption of this resortltion within
ten (10) days after the date of such ad9ption. Said,City'Clerk shall furt:,er
notify said property OWTlers of the necessity that, if they or .any person
occ.upying such property des iriS to conti.nu.e to recei'le e18c tric, C01rnm:<::1l.c.a tion or
other similar or associatffd service~ they or such occupant shall, by t~e date
fixed in this resolution, provide all necessary facility changes (!f! t!wir
premises so as to receive such service from the lines of the supplying utili;:y
or utilities at a new location, subject to applicable ru1'$, regulations and
tariffs of the respective utility or utilities on file I<ith t',€ PEblic Utili.ti€s

BE IT FURTHER RESOLVED that the evidence ShCW3 and the Cocncil hereby
finds that the reason for creation of such Underground Utility District is as
follows:
The said streets, roads or rights of way adjoin or pass thro-Jgh a c i vie
area, consequently, such undergrounding is more efficient than any other meth:od
and adds to the aesthetic appearance of the area so undergrounded.
On motion of Councilman Millis, seconded by Councilman Talh"~- a"d on
the following roll call vote, to wit:
AYES: Councilmen Talley, Millis, Wood, de Leon and Mayor Schlagsl
NOES: None.
