A RE�OLIJ'I'ION OF Tf� PLANNII� COP�LISSION OF
THE CITY OF AFt1�0Y0 GRANDE DENYING A VARTANCE,
CA�SE N0. 8�-98.
�+�=iERF'�1S, the Planning Comrnission of the City of Arroyo Grande has
considered Variance Applica.�ion No. 84-98, filed by John Kuden and rlanny
Frades, for a Variance to Section 9-4.913(a) of the Arroyo Grande City Code;

V�REAS, the Commission has held a public hearing on this application
in accordance with the provisions of the Arroyo Grande City Code; and
Wf�REAS, the Commissian f inds that the following conaitions exist:
1. There are no exceptional circ�nstances applying to the land,
buildings or use referred to in the application which do not
apply generally �o other land, buildings or uses in the same
district.
2. The granting of this variance is not necessary for the
preservation and enjoyrr,ent of substantial property rights
of the applicant.
3. Z"he granting of this application will, under the terms and
conditions of this particular case, materially affect
adversely the health or safety of persons residing in or
working in the neighborhood, and will be materially detri-
mental to the public welfare ar injurious to property or
improv�r�ents in said neighborhood:
4. The �3ranting of this application will be contrary to the
GeneLal Plan.
DI(�r7, THE��EFORE, BE IT RESOLVED that the Planning Commission of the
City of Arroyo gr.ande hereby d�nies said Variance. The decision of the
Planni:ng Coraniss�on is final unless appealed in accordance wi.th the provisions
of the Arroyo Grande City Code.
On motion by Commissioner Fischer, seconded by Corranissioner Carr, anrl
