AN ORDINANCE OF THE CITY OF ARROYO GRANDE TO AMEND CHAPTER 13
OF TITLE 8 OF THE ARROYO GRANDE MUNICIPAL CODE TO ADOPT BY
REFERENCE THE 1979 UNIFORM SWIMMING POOL CODE INCLUDING AMEND- .
MENTS THERETO CONCERNING ADMINISTRATIVE AUTHORITY, STOP ORDERS,
AND PENALTIES; REPEAL OF ALL CONFLICTING ORDINANCES.
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 13 of Title 8 of the Arroyo Grande Municipal Code is
amended to read as follows:
Section 8-13.01 ADOPTION OF UNIFORM SWIMMING POOL CODE
For the purpose of providing minimum requirements and standards for the
protection of the public health safety and welfare, that certain Code designated
as the Uniform Swimming Pool Code, 1979 Edition, published by the International
Association of Plumbing and Mechanical Officials, three (3) copies of which have
been filed for use and examination by the public in the office of the City Clerk,
is hereby adopted by reference and made a part of this chapter as though set forth
in this chapter in full, subject, however, to the amendments, additions and deletions
set forth in this chapter, and said Code shall be known as the "Swimming Pool Code"
for the City of Arroyo Grande.
Section 8-13.02 AMENDMENT TO PART 1.5 ADMINISTRATIVE AUTHORITY
Part 1.5 the Administrative Authority shall be the Building Official or his
Authorized Representative.
Section 8-13.03 AMENDMENT TO SECTION 1.14-STOP ORDERS
Section 1.14 whenever any work is being done contrary to the provisions of
this Code, the Administrative Authority or his Authorized Representative may order
the work stopped by notice in writing served on any persons engaged in the doing
or causing such work to be done, and any such persOnS shall forthwith stop such
work until authorized by the Building Official to proceed with the ~ork. If unable
to serve such persons with a notice, the Building Official shall post the stop order
in a prominent place on the site. Such posted notice shall only be removed by
the Building Official. Any person proceeding with unauthorized work after being
served or having a notice posted on his job site, shall be deemed guilty of a
separate offense for each and every day or portion thereof during which such work
is being performed.
Section 2. That Ordinance No. 113 c. S. of the City of ArrOyo Grande entitled
an Ordinance of .the City of Arroyo Grande amending Title 8 of the Arroyo Grande
Municipal Code by adding Chapter 13 thereto to provide for adoption of the Uniform
Swimming ?ool Code 1973 Edition and all other Ordinances or parts of Ordinances
in conflict herewith are repealed.
Section 3. This Ordinance shall be in full force and effect thirty (30) days
after its passage, it shall be published once, together with the names of the
Councilpersons voting thereon, in The Five Cities Times-Press-Recorder.
On motion of Council Member Vandeveer, seconded by Council Member Smith, I
and on the following roll call vote, to wit:
AYES: Council Members Smith, Hogan, Millis, Vandeveer, and Mayor pope
NOES: None
ABSENT: None
