ORDINANCE 227 C.S.
ORDINANCE OF THE CITY OF ARROYO GRANDE TO AMEND CHAPTER I
OF TITLE 8 OF THE ARROYO GRANDE MUNICIPAL CODE, TO ADOPT BY
REFERENCE THE 1979 UNIFORM BUILDING CODE, INCLUDING AMENDMENTS
THERETO CONCERNING STOP ORDERS, CORRECTION, AND EXCEPTIONS,
AND THE REPEAL OF ALL CONFLICTING ORDINANCES
THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE DOES ORDAIN AS FOLLOWS:
Section I: Chapter 1 of Title 8 of the Arroyo Grande Municipal Code
is amended to read as follows:
Section 8-1.01 ADOPTION OF UNIFORM BUILDING CODE I
There is adopted for the purpose of providing minimum standards to
safeguard life or limb, health, property and public welfare, that certain code
known as the Uniform Building Code, 1979 Edition, and the Uniform Building Code
Standards, 1979 Edition, published by the International Conference of Building
Officials, 5360 South Workman Mill Road, Whittier, California, 90601, and the
whole thereof including the Table of Contents, Chapters 32, 35, 38, 48, 49, 51,
53 and 55 of the appendix, save and except such portions as are hereafter deleted,
added thereto, modified or amended of which code, ame~dments and secondary code,
not less than three (3) copies have been and are now on file in the office of the
City Clerk and the same are adopted and incorporated as fully as set out at i

length herein. !
Section 8-1.02 ADMINISTRATION !
A new section entitled "Administration" is hereby adopted to read as
follows: In order for the orderly enforcement of the Uniform Building Code, 1979 I
Edition, as adopted by Section 8-1.01 there is hereby adopted the Uniform
Administrative Code, Chapters 1,2, 3, and Table No. 3-A-Building Permit Fees, as
published by the International Conference of Building Officials, save and except
such portions as are hereinafter deleted, added thereto, changed or amended, not
less than three (3) copies of said Uniform Administrative Code are now on file
in the office of the City Clerk and said Administrative Code is hereby adopted
and incorporated herein by reference as though herein set forth in full.
Section 8-1.03 CHIEF BUILDING INSPECTOR: OFFICE CREATED: POWERS AND DUTIES
The office of Chief Building Inspector is hereby created, and the
Chief Building Inspector or his authorized representative is hereby authorized
and directed to administer and enforce all the provisions of this Chapter and Codes
adopted by this chapter, and for such purpose, he shall have the powers of a
Pol ice Officer.
Section 8-1.04 BUILDING OFFICIAL
"Building Official", as used in this title, shall mean the Director of
Planning.
Sect ion 2: Amendments in said Uniform Building Code are as follows: ,
1. Section 202(d) of said Uniform Building Code is amended to read
as fo 11 ows :
(d) Stop Orders: Whenever any work is being done contrary to the
provisions of this Code, or in violation of any other Code or City
Ordinance, the Building Official may order the work stopped by notice
in writing served on any persons engaged in the doing or causing such
work to be done, and any such persons shall forthwith stop such work
until authorized by the Building Official to proceed with the work.
If unable to serve such persons with a notice, the Building Official
shall post the Stop Order in a prominent place on the site. Such
posted notice shall only be removed by the Building Official, Any
person proceeding with unauthorized work after being served or having
a notice posted on his or her job site, shall be deemed guilty of a
separate offense for each and every day or portion thereof during I
which such work is being performed. I

2. Section 304 of said Uniform Building Code is amended by adding a
new Sub-section (h) to read as follows:
(h) No utilities shall be authorized to be connected until such time
as a final building inspection is approved and al lather City
Department requirements have been completed.
3. Section 3305 (j) of said Uniform Building Code is hereby amended
by adding the following to the exception "Stairways less than four
risers need not have handrai 1s."
Section 3: That Ordinance No. 143 C.S. of the City of Arroyo Grande
I entitled an Ordinance of the City of Arroyo Grande Amending Chapter 1, of Title 8,
of the Arroyo Grande Municipal Code to provide for adoption of the 1976 Edition of
the Unifo~m,Building Code and all other Ordinances or parts of Ordinances in
conflict herewith are repealed.
Section 4: If any section, subsection, sentence, clause or phrase

of this Ordinance is for any reason held to be invalid, such decision shall not I
affect the validity of the remaining portions of this Ordinance. The Counc i I
hereby declares that it would have adopted the Ordinance and each section, sub-
section, sentence, clause or phrase thereof, irrespective of the fact that any
one or more sections, subsections, sentence, clause or phrases be declared I.
inval id.
Section 5: This Ordinance shall be in full force and effect thirty (30)
days after its passage, it shall be published once, together with the names of the
Councilpersons voting thereon, in the Five Cities Times-Press Recorder.
Section 8-1.05 GRADING PLANS INSPECTION
Prior to the issuance of a building permit, all construction plans may
be reviewed by the Department of Public Works for compliance with Title 7, Chapter I,
"Grading and Excavating". Said conditions by the Department of Public Works
shall be enforced by the Building Department and/or Director of Public Works and
no occupancy or utilities shall be authorized until said conditions have been
campi ied with.
On motion of Council Member Vandeveer, seconded by Council Member Smith,
and on the following roll call vote, to wit:
