RESOLUTTON OF THF PLANNING COrIMISSION OF THE CITY OF
ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 83-90.
The Planning Commission finds that the Variance applied for by Aspen
Village Investors at 250 So. Elm Street meets the requirements of Section
7.3 of the Arroyo Grande Zoning Ordinance as amended, to allow for erection
of a 5 ft. fence in the front yard setback in the "R-G" Garden Apartment
Residential District on the following described property:
In the City of Arroyo Grande, County of San Luis Obispo,
State of California, Lot 45 and a Portion of Lot 46 of
Tract 10 as per map recorded in Book 5, Page 28 of Maps.
Also identified by Assessor's Parcel Nos: 77-153-37 and
77-153-46.
WHEREAS, the Planning Commission finds that:
(.a) The grar_ting of said application does not constitute a grant of
special privilege inconsistent with limitations upon other properties in
the vicinity and sa.Tne zoning in which this property is located, and (b)
because there are special circumstances applicable to the property (size-
shape-topography-location-surroundings), the strict application of the
Zoning Crdinance does deprive applicant's property of pr:ivi]_eges enjoyed
by other propert�_es in the vicir�ity and in th.e same zoning classification,
and approves sai� Variance for the following reason:
1. Would r.c� adversely affect abutting properties.
