PC R 82-915 V�54 The Planniiig Commission finds that the Variance applied for by Lee O. Webb at Oak Park Boulevard and Highway 101 meets the requirements of Section 7.3 of the Arroyo Grande Zoning Ordinance as amended, to allow for increase of the building height from 30 ft. to 35 ft. for proposed Motor Inn and Restaurant in the "H-S" Highway Service District on the following described property: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GI2ANDE GRANTING A VARIANCE, CASE NO. 82-86. Lot 4 of Tract No. 604, in the City of Arroyo Grande, County of San Luis Obispo, State of California, according to the map recorded August 24, 1977 in Book 9, Page 39 of Maps. WHEREAS, the Planning Commission finds that: (a) The granting of said application does not constitute a grant of special privilece inconsistent with limitations upon other properties in the vicinity and same zoning in which.this property is located, and (b) because there ar_e specia? circuristances applicable to the property (size-shape-topography-location-surroundings) the strict application of the Zoning Ordinance does deprive applicant's property of privileges er.joyed by other properties in tne vicinity and in the same zoning classification,�.- and approves said Variance for the following reasons: 1. It was d�terr,iined t'r.at special circumstances existed where by a f�.re could be fought from the roof line, if necessary, , because of the architectural design of the structure (r^ire D°,�artment memo dated June 28, 1982). More specifically, the memo re�lects upon the 30 ft. height limit as being critic�l, and the architectural drawings specify a 26 ft. distai;c� between the floor and the eave line elevation of thn tal.lPst portions of the motel. With grading, the maximum height b��w�en the eaves and the ground where the lac'd�r �rT�ll be placed should be approximately 28 ft. thus mitigating the concerns highlighted in the Fire Department's memo. 2. The rocf of the structure is to be constructed with a clay tile cover_ing, making it somecahat more fire retardant than many of the other structures in the City.
