OF AkROYO GRANDE DENYING A VARIANCE, CASE NO.

Tlie Planning Commission finds that the Variance applied for by
Don NlcHaney and Johr1 Wynn on South Elm Street does not meet the require-
ments of the Arroyo Grande Zoning Ordinance as amended, to allow for
reduction of the required front yard setback from 15 ft. to 9 ft. and to
reduce the open space requirement on the following described property:
In the City of Arroyo Grande, County of San Luis Obispo,
State of California, Lot 5, Block 8 of the Fair Oa}:s
Tract. Also identified by County Assessor's Parcel No.
77-171-02.
(a) in that it does constitute a grant of special privilege inconsistent with
limitations upon other properties in the vicinity and same zoning in which
this property is locuted, and (b) that because there are not special circura-
stances applicable to the property (size-shape-topography-location-
surroundinys) the strict application of the Zoning Ordinance does not deprive
applicant's property of privileges enjoyed by other properties in the vicinity
and in the sar,;s zoning.classification, and denies said Variance foz the f.ollow-
