PC R 80-788 V422 RESOLUTION NO. 80-788 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DENYING A VARIANCE, CASE NO. 80-71. The Planning Commission finds that the Variance applied for by Richard C. Davino at the corner of McKinley and Le Point Streets does not meet the requirements of the Arroyo Grande Zoning Ordinance as amended, to allow for reduction of the required square footage for both corner and interior lots on the following described property: In the City of Arroyo Grande, County of San Luis Obispo, State of California, Lots 1 and 2 in Block D of Le Point Addition to the Town of Arroyo Grande. Also identified by Assessor's Parcel No. 7-254-16. (a) in that it does constitute a grant of special privilege inconsistent with limitations upon other properties in the vicinity and same zoning in which this property is located, and (b) that because there are not special circum- stances applicable to the property (size-shape-topography-location-surround- ings) the strict application of the Zoning Ordinance does not deprive applicant's property of privileges enjoyed by other properties in the vicinity and in the same zoning classification, and denies said Variance for the following reasons: l. The two lots in question are buildable in their present location. 2. Reorientation of the two lots would have a detrimental visual effect in the appearance of McKinely Street. On motion by Commissioner Sebastian, seconded by Commissioner Cole, and by the following roll call vote, to wit: AYES: Commissioners Gerrish, Cole, Moots, Pilkington, Sebastian and Chairman Gorsline NOES: None ABSENT: Commissioner Fischer the foregoing Resolution was adopted this 2nd day of December 1980.
