PC R 80-761 V395 RESOLUTION NO. 80-761 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARTANCE, CASE NO. 80-69. The.Plaruiing Commission finds that the Variance applied for by James D. and Joan F. Leonard at 826 Creekside Drive, meets the requirements of Section 7.3 of the Arroyo Grande Zoning Ordinance as amended, to allow for encroach- ment and retention of a patio cover in the "R-1" Single Family Residential District on the following described property: Lot 4 of Tract No. 562 in the City of Arroyo Grande, County of San Luis Obispo, State of California, according to Map recorded December 26, 1975 in Book 8, Page 82 of Maps. Also identified by Assessor's Parcel No. 6-562-12 and known as 826 Creekside Drive (.a) in that.it does not constitute.a grant of special privilege inconsistent with limitations upon other properties in the vicinity and same zoning in which this property is located, �b). that because there are special circumstances applicable to the property, the strict application of the Zoning Ordinance does deprive applicant's property of privileges enjoyed by other properties . in the vicinity and in the same zoning classification, (c) because of the unique elevation conditions between the applicant and his neighbor, applicant is entitled to the privacy of his own rear yard area, (d) encroachment of the patio structure does not appear to be objectionable, and (e) when the landscaping reaches maturity, it will create a screening effect probably greater than that of the construction of the patio, and grants said Variance for the following reason: ' 1. Would not adversely affect abutting properties.
