RESOLUTION NO. 78-618 Z
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT
TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE
AS PROVIDED BY CHAPTER 4, ZONING, ARTICLE 32 OF SAID
CODE.
WHEREAS, the Planning Commission of the City of Arroyo Grande, California
has held a public hearing on the application of Joseph Zogata to amend the
Municipal Code of the City of Arroyo Grande as provided by Chapter 4, Article
32, of said Code to rezone all that property described as follows from "RA
District to "R District:
"In the City of Arroyo Grande, County of San Luis Obispo, State
of California, Westerly 15.6 acres of Lot 9 of the E. W. Steele ,
Resubdivision of Ranchos Corral de Piedra, Pismo and Bolsa de
Chamisal, as shown on the map recorded in Book 8, Page 21 of
Records of Survey. Also identified as Assessor's Parcel No.
7-441-01. "
WHEREAS, the Planning Commission feels that the public interest and general
welfare does require such an amendment, and
WHEREAS, the Commission minutes including a list of persons who testified
at the public hearing, summary of fact and findings, and copies of any maps
pertinent to the proposal are on file and hereby declared to be part of said
Resolution.
NOW, THEREFORE, BE IT RESOLVED that said Planning Commission hereby
recommends approval of the amendment as applied for, for the following reasons:
1. Zone change from "RA-B3" District to "R-1-D" District would be in
keeping with the Land Use Plan.
2. Change would be compatible to and in keeping with the surrounding
developments and zoning
subject to the following conditions:
1. Pearwood Avenue is not to be extended on to the Zogata property
intersecting with Stage Coach Road.
2. Oak Hill Road is not permitted to provide frontage for the lots
from the proposed subdivision.
3. Minimum lot size for the proposed development be 7,000 square feet.
4. That the prelimina.ry plan la'�elled Subdivision Study #3 shall serve
as a general guideline, and its circulation or lot configuration
should not be interpreted as final until such time as the Subdivision
Review Committee has reviewed and conditioned said plat.
On motion by Commissioner Moots, seconded by Commissioner Ries, and by
the following roll call vote, to wit:
AYES: Commissioners Moots, Ries, Simmons and Chairman Gerrish
NOES: Commissioners Cole, Harris and Vandeveer
ABSENT: None.
