RESOLUTION NO. 08-2068
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE APPROVING PLANNED
SIGN PROGRAM NO. 08-002, APPLIED FOR BY BANK OF
AMERICA FOR PROPERTY LOCATED AT 200 WEST
BRANCH STREET
WHEREAS, the Planning
Planned Sign Program No
West Branch Street; and
Commission of the City of Arroyo Grande has considered
08-002, filed by Bank of America for property located at 200
WHEREAS, the Planning Commission of the City of Arroyo Grande has held a public
hearing on Planned Sign Program No. 08-002 in accordance with the City Code; and
WHEREAS, the Planning Commission has found that this project is consistent with the
City's General Plan and Development Code; and
WHEREAS, the Planning Commission has reviewed this project under the provisions of
the California Environmental Quality Act (CEQA) and has determined that the project is
categorically exempt under Section 15311 of the CEQA guidelines; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, that the following circumstances exist:
1. The proposed signage is consistent with the goals, objectives, policies and
programs of the Arroyo Grande general plan, specific plan, and any
applicable design guidelines or approvals and has been reviewed by the
Architectural Review Committee and was found to be consistent with section
16.60 of the Development Code; and
2. The proposed signage conforms to applicable development standards and
provisions of Municipal Code and will not be detrimental to the public health,
safety and welfare; and
3. The physical location or placement of the signage is compatible with the
surrounding neighborhood and does not pose a safety risk.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves Planned Sign Program No. 08-002, with the above
findings and subject to the conditions as set forth in Exhibit "A", attached hereto and
incorporated herein by this reference.
On motion by Commissioner Barneich, seconded by Commissioner Tait, and by the
following roll call vote, to wit:

COMMUNITY DEVELOPMENT DEPARTMENT
This approval authorizes a Planned Sign Program for Bank of America located at 200
West Branch Street. Approved signage includes the installation of four (4) wall signs, all
with 15-inch channel letters, and the existing monument sign to remain the same (grey
color), as summarized in the table below:

1. The applicant shall ascertain and comply with all Federal, State, County and City
requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Planned Sign Program
No. 08-002.
3. Development shall occur in substantial conformance with the plans presented to the
Planning Commission at the meeting of August 19, 2008 and marked Exhibit "B".
4. All UL listing labels shall be located on the top of the sign so that it is not visible
from below.

5. The applicant shall agree to defend at his/her sole expense any action brought
against the City, its present or former agents, officers, or employees because of the
issuance of said approval, or in anyway relating to the implementation thereof, or in
the alternative, to relinquish such approval. The applicant shall reimburse the City,
its agents, officers, or employees, for any court costs and attorney's fee's which the
City, its agents, officers or employees may be required by a court to pay as a result
of such action. The City may, at its sole discretion, participate at its own expense in
the defense of any such action but such participation shall not relieve applicant of
his/her obligations under this condition.
6. The channel letter sign located on the back of the building facing residents on
Larchmont Drive shall be turned off every night no later than 10:00 PM.
BUILDING AND FIRE DEPARTMENT CONDITIONS
7. The project shall comply with the most recent editions of the California State Fire
and Building Codes and the Uniform Building and Fire Codes as adopted by the
City of Arroyo Grande.
8. Building and/or electrical permits shall be required for all signs prior to their
installation. Certain types of signs may be exempt from building permits. To
determine which types are exempt, provide the Building Division with location and
type of sign and a determination will be made. This must be done prior to the
installation of the sign. If a building permit is required the applicant shall pay permit
fees in effect at the time of building permit issuance.
9. All electrical work done on site shall require an electrical permit prior to
commencing the work.
10. The new State verbiage for handicap access signs shall be used.
PUBLIC WORKS DEPARTMENT CONDITIONS
11. Sign construction shall adhere to Sections 10.12.010 and 10.12.020 of the City of
Arroyo Grande Municipal Code.
12. Directional and accessory signs shall not obstruct sight distance at any of the
driveway intersections.
