PC R 08-2067RESOLUTION NO. 08-2067 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TIME EXTENSION 08-005 FOR TENTATIVE TRACT MAP 04-004 AND PLANNED UNIT DEVELOPMENT 04-004; LOCATED ON EL CAMINO REAL (BEHIND ARCO); APPLIED FOR BY LEONARD GRANT WHEREAS, the Planning Commission adopted Resolution No. 06-2010 which approved Tentative Tract Map 04-004 and Planned Unit Development 04-004 on .August 15, 2006; and WHEREAS, the Planning Commission has considered a request for a one-year time extension for Tentative Tract Map 04-004 and Planned Unit Development 04-004, applied for by Leonard Grant; and WHEREAS, the Planning Commission finds, after due study and deliberation, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved project to be injurious to the public health, safety, or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande approves a one-year time extension for Tentative Tract Map 04-004 and Planned Unit Development 04-004, with the above findings and subject to all original conditions as set forth in Exhibit "A" attached hereto and incorporated herein by this reference. On a motion by Chair Ray, seconded by Commissioner Keen, and by the following roll call vote: AYES: Chair Ray, Commissioners Keen, Barneich, Ruth and Tait NOES: None. ABSENT: None. The project is eligible for a maximum of two (2) more one (1) year time extensions, pursuant to Section 66452.6 (g) of the Government Code. COMMUNITY DEVELOPMENT DEPARTMENT GENERAL CONDITIONS: The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Tentative Tract Map 04-004 and Planned Unit Development 04-004. � � 3. All conditions of approval for the project shall be included in construction drawings. 4. The applicant shall, as a condition of approval of this application, defend, indemnify and hold harmless the City of Arroyo Grande, its present or former agents, officers and employees from any claim, action, or proceeding against the City, its past or present agents, officers, or employees to attack, set aside, void, or annul City's approval of this subdivision, which action is brought within the time period provided for by law. This condition is subject to the provisions of Government Code Section 66474.9, which are incorporated by reference herein as though set forth in full. � �
