PC R 07-2049RESOLUTION NO. 07-2049 A RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING THE CITY COUNCIL ADOPT A RESOLUTION APPROVING GENERAL PLAN AMENDMENT 07-002 AND AN ORDINANCE APPROVING DEVELOPMENT CODE AMENDMENT 07- 005 TO UPDATE THE 2005 AMENDED HOUSING ELEMENT AND AMEND CHAPTER 16.80 OF THE DEVELOPMENT CODE REGARDING AFFORDABLE HOUSING REQUIREMENTS AND ADDING CHAPTER 16.82 REGARDING DENStTY BONUSES FOR CONSISTENCY AND COMPLIANCE WITH STATE LAW � WHEREAS, the City Council adopted Ordinance No. 514 C.S. on March 28, 2000 to include new Chapter 16.80 of the Development Code regarding Affordable Housing Requirements; and WHEREAS, the City Council adopted Resolution No. 3727 on November 25, 2003 to adopt the 2003 Housing Element of the General Plan; and WHEREAS, the City Council adopted Resolution 3823 on March 8, 2005 to amend the 2003 Housing Element of the General Plan; and WHEREAS, the California Department of Housing and Community Development (HCD) certified the City's Amended 2005 Housing Element on June 22, 2005; and WHEREAS, Government Code Section 65915 has been revised to include new State- mandated density bonuses and development concessions for qualified affordable housing projects; and WHEREAS, Chapter 16.80 of the City's Development Code and the Amended 2005 Housing Element are inconsistent and incompliant with Government Code Section 65915, and adoption of Development Code 07-005 and General Plan Amendment 07-002 will bring the Development Code and Housing Element into compliance with State law; and WHEREAS, a duly noticed public hearing was held by the Planning Commission of the City of Arroyo Grande on October 16, 2007, at which time all interested persons were given the opportunity to be heard; and WHEREAS, the Planning Commission has reviewed the proposed amendments to Chapter 16.80 of the Development Code and the Amended 2005 Housing Element in compliance with the California Environmental Quality Act (CEQA) and has determined that the negative declaration previously adopted for the 2003 Housing Element is adequate for the proposed General Plan Amendment, and that the Development Code Amendment is exempt per CEQA Section 15061(b)(3). RESOLUTION NO. 07-2049 PAGE 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby recommends that the City Council amend the Housing Element of the General Plan and Municipal Code Section 16.08 related to affordable housing requirements and adding Chapter 16.82 regarding density bonuses as identified in Exhibits "A" and "B" attached hereto and incorporated herein by this reference. On motion by Commissioner Marshall, seconded by Commissioner Keen, and by the following roll call vote, to wit: AYES: Commissioners Marshall, keen, Barneich, Tait, and Chair Ray NOES: None ABSENT: None the foregoing Resolution was adopted this 16�' day of October 2007.
