A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARROYO GRANDE APPROVING TIME EXTENSION CASE NO.
04-009 FOR AMENDED CONDITIONAL USE PERMIT CASE NO.
02-003; LOCATED AT COURTLAND STREET AND GRAND
AVENUE; APPLIED FOR BY PACIFIC HARBOR HOMES
WHEREAS, the applicant has filed Time Extension 04-009 to extend the expiration
date of Amended Conditional Use Permit 02-003 for one-year to September 24,
2005; and
WHEREAS, the Planning Commission of the City of Arroyo Grande has considered
Time Extension 04-009 on October 19, 2004 in accordance with the Municipal Code
of the City of Arroyo Grande; and
WHEREAS, the Planning Commission finds, after due study, and deliberation, that
there have been no significant changes in the General Plan, Municipal Code or
character of the area within which the project is located that would cause the
approved project to be injurious to the public health, safety, or welfare; and
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby recommends that the City Council approve a one-year time
extension for Amended Conditional Use Permit 02-003, filed by Pacific Harbor
Homes, with the above finding and subject to the conditions as set forth in Exhibit
„ A „
On motion of Commissioner Keen, seconded by Commissioner Arnold, and by the
following roll call vote, to wit:
AYES: Commissioners Keen, Arnold and Chair Guthrie
NOES: None
ABSENT: Commissioners Brown and Fowler

CONDITIONS OF APPROVAL
TIME EXTENSION 04-009

This approval authorizes a one-year time extension for Amended Conditional Use
Permit 02-003, which was originally approved by the City Council on September 24,
2002, allowing the construction of a 108-unit senior housing complex located at
Courtland Street and East Grand Avenue.

The applicant shall ascertain and comply with all Federal, State, County and
City requirements as are applicable to this project.
The applicant shall comply with all conditions of approval for Amended
Conditional Use Permit 02-003.
3. Amended Conditional Use Permit 02-003 shall automatically expire on
September 24, 2005. The applicant may apply for four (4) additional one-year
time extension, pursuant to Section 66463.5 of the Subdivision Map Act.
4. For all building permits issued in the subject development, the applicant shall
pay those development impact fees that are in effect at the time the permits
are issued.
5. The projects' senior center shall be made available for reasonable senior
community access and use.
