I. RESOLUTION NO, 992
,
A RESOLUTION OF THE CITY COGNCIL OF THE CITY OF
ARROYO GRANDE REGARDING ITS POLICY TO ACCEPT
OFFERS TO DEDICATE UNIMPROVED ROADWAYS.
WHEREAS, the City of Arroyo Grand~'s existing policy is to normally
require that street improvements be instaUe,d to City's standards prior to
acceptance of property offered to the City for road purposes; and
WHEREAS, the City of Arroyo Grande is, from time to time, reql1estc;d
to accept deeds setting forth areas to be used for future road purposCcs; and
WHEREAS, under certain circumstances it could be contended that the
City of Arroyo Grande should be liable for n"gligently maintaining City
roadways after such have been offered to and accepted by the City even though
it may not be the intention of the City to immediately make use of said
dedicated property for road purposes; and
WHEREAS, the City of Arroyo Grande has determined that it is, in
certain cases, desirable that future roadways be determined in conjunction
with the development of property,
NOW, THEREFORE, BE IT RESOLVED that the following be accepted as a
guideline to be followed in th" acceptance of the required unimproved
roadway:
1, The property owner submit a title report covering the
proposed future roadway,
,,-, Where dedication is required an irrevocable and perpetual
offer to dedicate may be made to the City, and in cases of sub-
divisions that offer shall be recorded prior to recordation of the
final map and the recording information is to be noted on the final
map or lot split map,
3, Upon improvement of these streets as required by the City
of Arroyo Grande, the offer to dedicate will be accepted by the City.
On motion of Councilman Wood, seconded by Councilman de Leon and on the
following roll call vote, to wit:
AYES: Councilmen Millis, Wood, de Leon and Mayor Schlegel
NOES: None
ABSENT: Councilman Tall"y
the foregoing Resolution was passed and adopted this 13th day of June, 1972.
