PC R 03-1896RESOLUTION NO. 03-1896 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM CASE NO. 03-005, LOCATED AT 1401 EAST GRAND AVENUE, APPLIED FOR BY E.F. MOORE 8� CO. WHERAS, E.F. Moore & Co. has applied for a Planned Sign Program to allow signage for the Courtland & Grand Outdoor Plaza including signage for a Longs Drug Store, Starbucks, and Santa Barbara Bank & Trust; and WHEREAS, on August 19, 2003, the Planning Commission of the City of Arroyo Grande held a duly noticed public hearing to consider Planned Sign Program Case No. 03-005 in accordance with City Code; and WHEREAS, the Planning Commission reviewed and considered the information and public testimony presented at the public hearing, the staff report and other information that is part of the public record; and WHEREAS, the Planning Commission found, after due study, deliberation and public hearing, the following circumstances exist: The proposed signs are consistent with the goals, objectives, policies and programs of the Arroyo Grande General Plan. 2. The proposed signs conform to applicable development standards and provisions of the Development Code, and will not be detrimental to the public health, safety or welfare. 3. The physical location or placement of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Planned Sign Program Case No. 03-005, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. Moore & Co. 1401 East Grand Avenue (Courtland & Grand Outdoor Plaza) ► : � •►� •► COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes the placement of wall signs and monument signs within the Courtland & Grand Outdoor Plaza. 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Planned Sign Program Case No. 03-005. 3. This application shall automatically expire on August 19, 2005 unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 4. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of August 19, 2003 and marked Exhibits B1-B3, except as otherwise modified by these conditions. 5. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. - • •►� �T�I 6. Individual wall signs shall not exceed seventy (70) square feet. A ten percent (10%) deviation is allowable, subject to review and approval of the Community Development Director. RESOLUTION NO. 03-1896 PAGE 4 � •�ii ► •� 7. Development shall conform to the General Commercial zoning requirements and the Sign Ordinance except as otherwise approved. �: . :� : � •►��i 8. The UL listing labels shall be located on the top of all signs so that they are not visible from below. 9. Future tenants not approved through this Planned Sign Program shall submit separate sign applications. The Architectural Review Committee shall review all signs proposed within the Courtland and Grand Outdoor Plaza. 1 ► _► � : � ' ►1 ► � � •► 10. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande. � 11. The applicant shall obtain any necessary permits from the City's Fire and Building Department, as determined by the Chief Building Inspector.
