PC R 03-1888� I RESOLUTION NO. 03-1888 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING AMENDED CONDITIONAL USE PERMIT 03-005 LOCATED AT 504 EAST GRAND AVENUE, APPLIED FOR BY ED GLIDEWELL WHEREAS, the relocate Philly' s Market; and applicant has filed Amended Conditional Use Permit 03-005 to Restaurant to 504 East Grand Avenue in the former La Tapitia WHEREAS, the Planning Commission of the City of Arroyo Grande approved Conditional Use Permit 02-005 on March 5, 2002, which included several conditions of approval that have not been resolved; and WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Amended Conditional Use Permit 03-005 at a public hearing on July 15, 2003 in accordance with the Development Code of the City of Arroyo Grande; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and the Development Code; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for Implementation of CEQA and has determined that the proposed project is categorically exempt under Section 15303 of the CEQA Guidelines; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: Conditional Use Permit Findings: 1. The proposed use is permitted within the Highway Commercial district pursuant to the provisions of Section 16.36.030 of the Development Code, and complies with all applicable provisions of the Development Code, the goals and objectives . of the Arroyo Grande General Plan, and the development policies and standards of the City. 2 3 4 As conditioned, the proposed use will not impair the integrity and character of the district in which it is to be established or located. The site is suitable for the type and intensity of use that is proposed. There are adequate provisions for water, sanitation, and public utilities and services to ensure the public health and safety.
