A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE APPROVING TIME
EXTENSION 03-002 FOR TENTATIVE PARCEL MAP 99-
003 AND PLANNED UNIT DEVELOPMENT 99-003,
LOCATED AT 1171 ASH STREET
WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a
request for a one-year Time Extension for Tentative Parcel Map 99-003 and Planned
Unit Development 99-003 filed by Billy Sutton to subdivide a 23,566 square foot
parcel into three parcels of 10,594, 6,486 and 6,486 square feet located at 1171
Ash Street; and
WHEREAS, the Planning Commission approved the project on June 6, 2000; and
WHEREAS, the Planning Commission has found that this project is consistent with
the City' s General Plan; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, that there have been no significant changes in the General Plan, Municipal
Code or character of the area within which the project is located that would cause
the approved project to be injurious to the public health, safety, or welfare.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby approves a one-year Time Extension for Tentative Parcel Map
99-003 and Planned Unit Development 99-003, filed by Billy Sutton, with the above
findings and subject to the conditions as set forth in Resolution No. 00-1745. The
expiration of approval for Tentative Parcel Map 99-003 and Planned Unit
Development 99-003 shall now be June 6, 2004.
On motion of Commissioner Fowler, seconded by Commissioner Guthrie, and by the
following roll call vote, to wit:
AYES: Commissioners Fowler, Guthrie and Brown
NOES: None
ABSENT: Commissioners Arnold and Keen
the foregoing Resolution was adopted this 1 st day of July, 2003.

CONDITIONS OF APPROVAL
TIME EXTENSION 03-002 FOR
TENTATIVE PARCEL MAP 99-003 AND
PLANNED UNIT DEVELOPMENT 99-003
This approval authorizes a one-year time extension for Tentative Parcel Map 99-003
and Planned Unit Development 99-003 filed by Billy Sutton to subdivide a 23,566
square foot parcel into three parcels of 10,594, 6,486 and 6,486 square feet
located at 1 171 Ash Street
1. The applicant shall ascertain and comply with all Federal, State, County and
City requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Tentative Parcel
Map 99-003 and Planned Unit Development 99-003.
3. Tentative Parcel Map 99-003 and Planned Unit Development 99-003 shall
automatically expire on June 6, 2004. The applicant may apply for one
additional one-year Time Extension pursuant to Development Code Section
16.12.140.
4. The applicant shall agree to defend at, his/her sole expense any action brought
against the City, its present or former agents, officers, or employees because
of the issuance of said approval, or in anyway relating to the implementation
thereof, or in the alternative, to relinquish such approval. The applicant shall
reimburse the City, its agents, officers, or employees, for any court costs and
attorney's fee's which the City, its agents, officers or employees may be
required by a court to pay as a result of such action. The City may, at its sole
discretion, participate at its own expense in the defense of any such action but
such participation shall not relieve applicant of his/her obligations under this
condition.
5. For all building permits issued in the subject development, the applicant shall
pay those development impact fees that are in effect at the time the permits
are issued.
