PC R 03-1870� RESOLUTION NO. 03-1870 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING THAT THE CITY COUNCIL AMEND THE GENERAL PLAN AND ZONING MAP OF THE CITY OF ARROYO GRANDE, AMEND THE BERRY GARDENS SPECIFIC PLAN, AND APPROVE A VESTING TENTATIVE TRACT MAP AND PLANNED UNIT DEVELOPMENT IN GENERAL PLAN AMENDMENT 02-002, DEVELOPMENT CODE AMENDMENT 02-004, SPECIFIC PLAN AMENDMENT 02-001, PLANNED UNIT DEVELOPMENT 02-004 AND TENTATIVE TRACT MAP 02-001, FOR PROPERTY LOCATED AT THE INTERSECTION OF ASH AND COURTLAND STREETS, APPLIED FOR BY S&S HOMES WHEREAS, the City of Arroyo Grande Land Use Element Map indicates that the subject 5.23-acre property, located at the intersection of Ash and Courtland Streets, is located in the Medium Density (MD) land use category and in the Single-Family (SF) zoning district with a Specific Plan overlay; and WHEREAS, the applicant, S&S Homes, has filed General Plan Amendment 02-002 to change the land use category of the subject property from Medium Density residential (MD) to Medium High Density residential (MH) allowing up to 9.0 dwelling units per acre, Development Code Amendment 02-004 to change the zoning designation from Single- Family (SF) to Condominium/Townhouse (MF) with a Specific Plan overlay, Specific Plan Amendment 02-001 to include land use and development standards for Subarea 2 of the Berry Gardens Specific Plan, Planned Unit Development 02-004 to allow more flexibility in design and more efficient use of land, and Vesting Tentative Tract Map 02-001 to subdivide the property into forty-seven (47) residential lots ranging from3,128 to 7,409 square feet; and WHEREAS, adoption of the land use designation and zoning would establich land use, development and design standards for the above described area, and allow the property to be subdivided as proposed; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the residential development project at a duly noticed public hearings on March 4, 2003 and May 6, 2003 in accordance with the Development Code of the City of Arroyo Grande at which time all interested persons were given the opportunity to be heard; and WHEREAS, the Planning Commission has reviewed and considered the information and public testimony presented at the public hearing, staff report, and all other information and documents that are part of the public record; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: Based on the information contained in the staff report and accompanying RESOLUTION NO. 03-1870 PAGE 2 materials, the proposed General Plan Amendment amending the Land Use Map, Development Code Amendment amending the Zoning Map, Specific Plan Amendment amending Subarea 2 of the Berry Gardens Specific Plan, Planned Unit Development to allow greater flexibility in design, and Vesting Tentative Tract Map to subdivide the property ("the proposed project") is consistent with the goals, objectives, policies, plans, programs, intent, and requirements of the General Plan. 2. The proposed project will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern. 3. The proposed project is consistent with the purpose and intent of the Development Code. Residential development within the project area would be required to meet development and design standard under the MF zoning designation that insure orderly development. 4. The potential environmental impacts of the proposed project are insignificant or can be mitigated to a less than significant level, or there are overriding considerations that oufinreigh the potential impacts. fVOV1/, THEFtEFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby recommends that the City Council approve General Plan Amendment 02-002, Development Code Amendment 02-004, Specific Planned Amendment 02-001, Planned Unit Development 02-004, and Vesting Tentative Tract Map 02-001, through adoption of the Ordinance and Resolutions Exhibits "A", "B", "C" and "D", (as contained in the staff report) thereby changing the land use designation from Medium Density (MD) to Medium High Density (MH) with a Specific Plan overlay, changing the zoning designation from Single-Family (SF) to Condominium/Townhouse (MF) with a Specific Plan overlay, changing the Berry Gardens Specific Plan to include design standards for Subarea 2, approving a Planned Unit Development to allow more design flexibility, and approving a Tract Map to subdivide the property into forty-seven (47) residential lots. On motion by Commissioner Arnold, seconded by Commissioner Keen, and by the following roll call vote to wit: AYES: Commissioners Arnold, Keen and Chair Guthrie NOES: Commissioner Brown ABSENT: Commissioner Fowler the foregoing Resolution was adopted this 6` day of May 2003.
