MEMORANDUM TO: City Council FROM: Bill Robeson, Assistant City Manager/Public Works Director BY: Shannon Sweeney, City Engineer SUBJECT: Consideration of Acceptance of the 2022 Concrete Repair Project, PW 2022-07 DATE: April 23, 2024 SUMMARY OF ACTION: Consideration of acceptance of the 2022 Concrete Repairs Project (Project) and starting the one-year warranty period for defects that may arise. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: The final contract and change orders resulted in a total construction cost of $520,538 . The total construction costs consist of $520,538 for the direct contract amount and $0 for additional material quantities and field change orders (contingency costs). RECOMMENDATION: 1) Accept the project improvements as constructed by JJ Fisher Construction, Inc. in accordance with the plans and specifications for the 2022 Concrete Repair Project, PW 2022-07; 2) Direct staff to file a Notice of Completion; and 3) Authorize release of retention, thirty-five (35) days after the Notice of Completion has been recorded if no liens have been filed. BACKGROUND: On July 25, 2023, the City Council awarded a construction contract to JJ Fisher Construction, Inc. to complete the 2022 Concrete Repair Project in the amount of $398,351 and authorized the City Manager to approve change orders in the amount of $39,835 for unanticipated costs during the construction phase of this project. On August 22, 2023, the City Council increased the contract to include two add- alternatives from the original bid for a total additional cost of $122,187 and authorized the City Manager to approve change orders in the amount of $12,218.70 for unanticipated Item 9.f. City Council Consideration of Acceptance of the 2022 Concrete Repair Project, PW 2022 -07 April 23, 2024 Page 2 costs during the construction phase of this project. The base project cost and the add- alternates totaled $520,538. The project was deemed substantially complete on February 23, 2024. ANALYSIS OF ISSUES: The 2022 Concrete Repair Project consisted of removing tile bands in the sidewalk and around tree wells in the Village and replacing them with brick pavers, replacing the crosswalks in the Village with brick pavers, and installing permeable flexi-pave in the tree wells. The add-alternate items included additional improvements at the Mason Street/East Branch Street intersection and sidewalk improvements adjacent to the Alder Street/Fair Oaks Avenue intersection. The 2022 Concrete Repair project was completed to City staff satisfaction. The sidewalks and crosswalks are fully operational. No deficiencies have been noted by City staff and no complaints have been received by customers served by these new improvements. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Accept the 2022 Concrete Repair Project; 2. Do not accept the project; 3. Accept the project but do not authorize the release of retention; or 4. Provide other direction to staff. ADVANTAGES: The project is complete and accepting the improvements will allow staff to close out the project. DISADVANTAGES: No disadvantages have been identified in accepting this project. ENVIRONMENTAL REVIEW: On July 25, 2023, the City Council determined that construction of this project was categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Guidelines Class 1 Section 15301 Existing Facilities, Class 2 Section 15302 Replacement or Reconstruction, and Class 4 Section 15304 Minor Alterations of Land. No further environmental review is required. PUBLIC NOTIFICATION AND COMMENTS: The agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2.
