RESOLLUON NO. _984,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE SETTING FORTH ITS INTENTION TO SELL
REAL PROPERTY AND SETTING A DATE FOR HEARING TF.EREON
AS PROVIDED UNDER PROVISIONS OF GOVERNMENT CODE
SECTION 37420.
WHEREAS, the City of Arroyo Grande has no prospective use for the
hereinafter described parcel of property; and
WHEREAS, the hereinafter described parcel of property constitutes a
strip of property lying in front of and immediately adjacent to privately
owned property, and said parcel of property unless used by the City of Arroyo
Grande for right of way purposes will constitute unused property and will
detract from the use and appearance of the adjacent private property, and
will constitute a continuous obstruction to the free use of the adjacent
real property and represent an area which may be at any time changed as to
its use, and because of the uncertainty of the use of said strip or parcel
of property, the adjacent private property will be seriously depreciated in
its value;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARROYO GRANDE AS FOLLOWS:
1. The public interest and convenience will be served if the
hereinafter described parcel of real property set forth in
Exhibit "A" attached hereto is sold and conveyed,
2. That the City Council of the City of Arroyo Grande intends to
sell and convey the parcel of property described in Exhibit "A"
attached hereto and by reference incorporated herein, subject
to the following restrictions, to wi t :
a. No person may purchase any parcel of property except and
unless the purchaser is the owner of a parcel or parcels of
real property lying innnediately .adjacent and contiguous to the
parcel or parcels for which the purchase is attempted, provided
that upon the consent of the owner of the innnediately adjacent
and contiguous parcel of real property, a person not the owner
of innnediately adjacent or contiguous property may be
permitted to become the purchaser of the hereinafter described
parcel of real property.
3. That a hearing will be held in connection with said Council's
intention to sell and convey the parcel of real property
described in Exhibit "A" in accordance with the above restric-
t tions, at which time, any person objecting to said sale or
interested therein may appear and be heard thereon, Said
hearing will be held on the 13th day of June, 1972, at the
hour of 8:00 P.M. of said day in the Council Chambers in the
City Hall, in the City of Arroyo Grande, County of San Luis
Obispo, State of California,
4. The City Clerk of the City of Arroyo Grande is herewith ordered
to publish this resolution in the Five Cities Times-Press-
Recorder at least five (5) days prior to the date of said hearing.
5. Final action on the matter of sale of said property will be taken
at the Arroyo Grande City Council meeting of June 27, 1972, at
the hour of 8:00 P.M.
6. The parcel of real property herein referred to is described in
Exhibit "A" attached hereto.

A strip of land along the East side of Oak Park Road and along the South
side of the frontage road at the southeast corner of the interchange of U.S.
Highway 101 and Oak Park Road (formerly Eighteenth Street) City of Arroyo Grande,
San Luis Obispo County, State of California, more particularly described as

Beginning at the easterly terminus of the North right-of-way line of Rose
Street (formerly Elm Street) as indicated in Tract 46, Book 5 of Maps, Page 64,
in the Records of San Luis Obispo County, State of California;
thence, North 800 18' 00" West along said North right-of-way line of Rose
Street, 156,29 feet to a point on a former California Division of Highways
right-of-way line (Project V-SLQ-lOl-Ar. Gr., E" p, Bch,) which line is also
a boundary of the property relinquished by the State of California to the
County of San Luis Obispo on June 6, 1956, recorded September 21, 1956,
863 O,R. 135;
thence South 790 13' 21" West along said former right-of-way and/or
relinquished line, 231,25 feet to an angle point in said relinquishment line;
thence South 380 34' 00" West along said relinquishment line, 165.73 feet
to a point on a curve to the right;
thence, along a curve to the right with a radius of 20,00 feet (tangent
at the beginning of this course to a line bearing North 120 54' 31" West) for
a distance of 12,81 feet through an angle of 360 42' IS" to a point that is
80,00 feet easterly of the West right-of-way line of Oak Park Road;
thence, along a curve to the left with a radius of 740,00 feet (tangent
at the beginning of this course to a line bearing North 230 47' 44" Eas t) for
a distance of 134.90 feet through an angle of 100 26' 42" parallel with and
80,00 feet from said West right-of-way line of Oak Park Road or its curved
(R=660 feet) projection.
thence, along a curve to the right with a radius of 30,00 feet (tangent
at the beginning of this course to a line bearing North 130 21' 02" East) for
a distance of 35.55 feet through an angle of 670 53' 31" to a point that is
50,00 feet southerly of the boundary and access denial line of the California
Division of Highways, U,S, Highway 101, according to their Right-of-Way Map
for Project V-SLO-lOl-Ar. Gr" E" p, Bch,;
thence, North 810 14' 33" East along a line parallel to and 50,00 feet
from said boundary and access denial line, 59,12 feet;
thence, along a curve to the right with a radius of 1,150 feet (tangent
at the beginning of this course to the last described course) for a distance
of 362.94 feet through angle of 180 04' 57" to a point on the northerly pro-
longation of the easterly boundary of Lot 1, Block 1 of said Tract 46;
thence, South 90 42' 00" West along said northerly prolongation 24.03
feet, more or less, to the Point of Beginning.
Reserving therefrom an easement for purposes of drainage, ingress and
egress, water, sewer and utilities and the right to construct, maintain,
operate, replace, renew, remove and enlarge said lines, including access
